Conducted an investigation into allegations of inappropriate behavior guidance. Interviews conducted, records reviewed, physical plant and equipment inspected. Violations:
Standard #: 22VAC40-185-400-A
Description: Based on interviews conducted, it was determined that Staff #11 did not interact with children in a manner that provided needed help, comfort, and support. Evidence: 1. On 8/26/16, Staff #11 was heard by staff speaking to children in the group in a "...strong tone of voice..." that was heard outside of the classroom. 2. Staff #12 stated that she had her back to Staff #11 and Child #1 and was prompted to turn around to see what was happening because of Staff #11's " strong tone of voice." She described Staff #11 as being "...out of sorts that day..." 3. Staff #5 who heard Staff #11 speaking to the children in a "strong tone of voice" from the hallway outside of the classroom, entered the classroom and heard Staff #11 tell several children in the bathroom to "get out." She described Staff #11 as, "...visibly frustrated..." and her tone of voice as being not appropriate for behavior guidance and as a result, directed Staff #11 to leave the classroom immediately. 4. Staff #11 described herself as being frustrated and speaking firmly to Child #1 when she stated, "...let's sit in the chair...I said sit down."

Plan of Correction: Immediate Correction: Upon learning of the allegation, the teacher was immediately removed from the classroom, and was counseled on appropriate voice tones. Additionally, all staff have been reminded of maintaining consistent positive reinforcement with positive voice tones and phrases at all times and with all age groups. They will be attending Positive Guidance training on October 3, 2016. Maintaining Compliance: All staff will be retrained in implementing positive voice tones and phrases for all children. The training will take place on October 3, 2016. Training in positive voice tones and phrases will be offered at least every 6 months thereafter and will be part of all newly hired staff orientation.

Standard #: 22VAC40-185-410-1
Description: Based on interviews conducted, it was determined that a staff person used a forbidden action of roughly handling a child. Evidence: 1.On 8/26/16, Staff #11 and Staff #12 were supervising 16 children in the 2 year-old group and getting the children ready to eat lunch. They said the children were "not listening" to their instructions that day and described the classroom as, "...hectic...frustrating...overwhelming...the kids were off that day..." Staff #5 described the classroom as, "...chaotic..." 2. Staff #11 and Staff #12 further stated that Child #1, a 3 year-old, arrived to the center crying that day and proceeded to have several "temper tantrums" that included the child screaming, flailing her arms and legs, and throwing her self on the floor. 3. At approximately 11:45am, Child #1 was placed in a chair at the table to eat lunch. Child #1 then repeatedly attempted to move to the chair beside her and to push the child occupying that chair out. Each time Staff #11 put Child #1 back in her own chair. According to Staff #12, the last time, Staff #11 picked Child #1 up by lifting her from underneath of her arms and in a "quick movement" she "roughly put her in the chair." In the process, Child #1's leg to hit the arm of the chair. A bruise type marking on the inner thigh was observed by Staff #2 as she comforted the crying child. Moments later, Staff #12 described the incident to Staff #5 as " she [Staff #11] slammed her [Child #1] in the chair." 4. Staff #12 stated that Child #1 immediately began screaming and stated "...ouch my leg...", Staff #11 stated that the child immediately began screaming and pushed her chair back from the table. 5. A bruise type marking on the inner thigh was observed on Child #1's right leg. Staff #12 described the mark as, "...a greenish bruise. Staff #5 and Staff #2 described the mark as, "...a red mark..." Staff #11 wrote in a written accident report, "When I was trying to put [Child #1] in a chair her leg got stuck in an awkward position which resulted in her hitting her leg and getting a bruise."

Plan of Correction: Immediate Correction: Upon learning of the allegation, the teacher was immediately removed from the classroom, and ultimately has left the company. All staff will be attending training on Positive Guidance on October 3, 2016. Maintaining Compliance: All staff will be retrained in Positive Guidance techniques when working with children of all ages. The training will take place on October 3, 2016. Training in Positive Guidance will be offered at least every 6 months thereafter and will be part of all newly hired staff orientation.
