22VAC40-185 STAFFING AND SUPERVISION.
The licensing inspector conducted a non-mandated self-reported inspection regarding an incident that occurred on 6/12/17, and was self-reported on the evening of 6/12/17 by the centers administration. Interviews with staff were conducted regarding this incident. There are 2 violations resulting from this incident. Thank you for your time and cooperation. Standard #: 22VAC40-185-340-A Description: Based on staff interviews the facility failed to maintain compliance with this standard as required relating to ensuring children are provided care, protection, and guidance. Evidence: On 6/21/17 a 14 month old child was left outside by staff #1 and #2 as they were returning to the classroom from the playground. Staff #2 stated that she had her 3 children in the buggy, from a stroll around the playground, when it was time to go inside. Staff #2 stated that she was bringing her children into the room in the buggy, and that staff #1 was bringing her children inside from the playground as well. Staff #2 stated that child #1 was not in her buggy, as the 4th buggy seat had no safety strap and wasn't being used, therefore Child #1 was with staff #1, who had the group of mobile children totaling 5. Staff #2 stated that staff #5 brought child #1 into the classroom approximately 2 minutes later stating you all left her on the playground. Staff #1 and #2 failed to ensure the care, protection, and guidance of child #1 for approximately 2 minutes as they entered the classroom with the other children, except for child #1 who was left outside on the playground. Plan of Correction: Staff 1 was the program lead and responsible for the classroom. Staff 1 was terminated for not following policy when transitioning from one area to the next. Staff 2 was put on 30 day probation and retrained on transition policy and the importance of counting children as they come inside from the playground. Also, "sweeping" the playground once the children are lined up and ready to come to ensure all children have been accounted for.
Standard #: 22VAC40-185-340-F Description: Based on staff interviews the facility failed to maintain compliance with this standard as required relating to supervision of the children. Evidence: Child #1, 14months old, was not in sight and sound supervision as required on 6/12/17 for approximately 2 minutes as she was left outside on the playground by staff #1 and #2. Staff #1 stated that she was in charge of the 3 children she had in her buggy, and was getting them inside while staff #1 was in charge of the 5 mobile children. Staff #1 stated that she and staff #2 had gotten both groups inside from the playground and closed the door. Staff #1 stated that approximately 2 minutes later staff #5 brought child #1 into their classroom stating you left her outside. Staff #4 and #5 stated that staff #5 was helping their children get water when staff #5 looked out the window in the door she was standing at and said oh no they left child #1 outside. Staff #4 stated that she said well go out and get her. Staff #4 stated that child #1 was sitting in the mulch area of the playground exactly where she had seen her when she was getting her children into the classroom from outside. Staff #4 and #5 stated that the approximate time was no more than 2 minutes as they had just gotten inside and were getting the children water. Staff #5 returned child #1 to her classroom, to staff #1 and #2, informing them that they had left child #1 outside on the playground. Plan of Correction: Staff 1 was the program lead and responsible for the classroom. Staff 1 was terminated for not keeping all children within sight and sound. Staff 2 was put on 30 day probation and retrained on policies related to supervision of children.
