Comments:
An unannounced monitoring inspection was completed as a part of the probation of the license. The probation was effective for 12 months beginning July 2016. There were 44 children present in three groupings with five staff directly supervising and two to three additional administrative staff present. Five children's records and three staff records were reviewed. One emergency medication was observed. The inspector arrived at the center at 12:15 pm and departed at 4:15 pm. The children were observed during nap (quiet time for school-agers), during afternoon snack, during group games, and during free play time in the classrooms. There was discussion with the director about the following: new background check requirements, subsidy requirements, the upcoming renewal inspection which is the next inspection (items to be reviewed at that inspection), outside the building of the exit from the toddler room (items that may be a hazard to effective evacuation).

Standard #: 63.2-1720.1-A
Description: Based on record review and observation, the center failed to ensure that the child day center did not hire for compensated employment and continue to employ a staff who was alone with, in control of, and supervising children who (i) had been convicted of any barrier crime as defined in ? 19.2-392.02 or (ii) is the subject of a founded complaint of child abuse or neglect within or outside the Commonwealth. Evidence: 1. Staff #1's Criminal Record Check (CRC) completed by the VA State Police on 6/14/17 showed felony convictions within the last five years. A felony conviction that is not over five years old is a barrier crime as defined by 19.2-392.02 of the Code of Virginia. Staff #1 was hired 5/12/17 and was observed working during the inspection in a classroom alone with a group of children.

Plan of Correction: This is as written by the program director: Staff had letter from Governor stating a restoration of rights in the state of VA. Staff references was from previous child care center that was a center that receives subsidy. Staff is enrolled at DCC for child care classes. Staff will be terminated at 3:15 pm on 7/28/17. Correction for future employees will be a signed statement added to the employee file and policies and procedures which reads as follows: I understand that background checks for State of Virginia State Police, Central Registry are completed within 30 days of employment. I understand that I will not be alone with children in the facility until the forms return and show no findings. I understand that findings listed in the barrier crimes list will be automatic termination. This will be added by Aug. 2, 2017. Each staff will receive a copy and it will be placed in their file by Aug. 5, 2017. The policies and procedures manual will be updated by Aug. 5, 2017.
