Comments:
An unannounced monitoring inspection was conducted today, January 30, 2024, to check for compliance regarding an Intensive Plan of correction (IPOC) that was submitted to the department on November 12, 2023. The inspector was on site from approximately 11:11 am until 12:50 pm. There were ten children present with two caregivers supervising for a value of 22 points. Two resident children were also present. Children were observed watching a movie, coloring, and playing with blocks. Later children had lunch. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, special care and emergencies and nutrition. Ten children?s records, and two caregiver records, and one household member record were reviewed. The inspector interacted with the caregiver and children in care.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-800-100-A
Description: Based on review of ten children?s records, the provider did not obtain documentation of a physical examination by or under the direction of a physician prior to a child?s attendance or within 30 days after the first day of attendance.

Evidence:

1. The record of child #9, enrolled 04/20/2023, contained a school health form with the date of a physical, however the form did not contain the results of the physical nor a signature of a physician.
2. The provider acknowledged the form was not complete or signed by a physician.

Description: Based on review of two caregiver records, the provider did not ensure each caregiver obtained a current report of tuberculosis screening every two years from the date of the first screening.

Evidence:

1. The record of caregiver #1 contained documentation of a tuberculosis screening dated 08/30/2021, exceeding two years.
2. The record of caregiver #2 contained documentation of a tuberculosis screening dated 08/30/2021, exceeding two years.
3. The provider stated a current tuberculosis screening had not been obtained for either caregiver.

Standard #: 8VAC20-800-240-A
Description: Repeat:
Based on observation, the provider did not ensure areas and furnishings of the family day
home, inside and outside, were maintained in a clean, safe, and operable condition.

Evidence:

1. There was an abundance of boxes, packaged food, plastic wrapped packages of diapers, wipes, plastic bags, a vacuum cleaner, diaper trash can, and other equipment around and under the two cribs located in the kitchenette area of the home. The items presented a tripping hazard, possible choking hazard and created a situation where heavy equipment could be pulled down by a child in care.
The diaper changing table also located in the kitchenette area in between the two cribs has peeling paint.
3. The provider acknowledged that the areas used by children were not clean.
4. An outdoor, single seat swing, approximately six feet in height was observed in the backyard where children play. The swing was not anchored to the ground. The licensing inspector was able to lift the swing support poles easily off the ground. The swing poses a risk of tipping over when used.
5. The caregiver acknowledged the swing was not anchored to the ground.

Description: Based on observation, the provider did not ensure infant walkers shall not be used.
