Comments:
This inspection was conducted by licensing staff using an alternate remote protocol necessary due to a state of emergency declared by the Governor of Virginia in response to the COVID-19 pandemic.

The department received a self-reported incident regarding allegations in the areas of behavior guidance and forbidden action, and a subsequent inspection was initiated on April 13, 2021 and concluded on May 26, 2021. The inspector contacted the vendor by telephone to conduct the investigation. The inspector emailed the vendor a list of documentation required to complete the investigation, interviewed additional staff and viewed video.

The evidence gathered during the investigation supported the self-report of non-compliance with standards or law, and violations were issued. Any other violations not related to the self-report but identified during the course of the investigation can also be found on the violation notice.

Violations:
Standard #: 22VAC40-665-680-A
Description: Based on interviews, video and documentation review, the vendor did not ensure behavioral guidance was constructive in nature, or age and stage appropriate.

Evidence:

1. A video recording of a March 31, 2021 virtual learning class showed Child A (six years old), playing with headphones, while participating in online learning. The video shows Staff #1 putting the headphones on the head of Child A. [Child A] takes off the headphones and Staff #1 forcefully puts them back on [Child A?s] head leaning within inches of [Child A?s] face, yelling, ?Do you understand me?, ?Do you hear me? and ?Cut it out?, while pushing the child?s chair in.
2. Three witnesses who viewed or logged on as part of the virtual learning class confirmed Staff #1 yelled in the face of Child A.

Plan of Correction: Staff was immediately removed from classroom. Investigation was done.

Standard #: 22VAC40-665-690-1
Description: Based on interviews, video and documentation review, the vendor did not ensure physical punishment, including striking, roughly handling or shaking a child, was not used as punishment.

Evidence:

1. A video recording of a March 31, 2021 virtual learning class showed Child A (six years old) sitting sideways in a chair, fidgeting with headphones. The video shows Staff #1 walking up, roughly grabbing the arm of Child A, taking away the headphones. Child A is heard crying out on the video.
2. Three witnesses who viewed or logged on as part of the virtual learning class confirmed Staff #1 roughly grabbed Child A by the arm.

Plan of Correction: Staff was immediately removed from classroom. Investigation was done.
