This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documents review, interviews and a virtual tour of the program.
A complaint inspection was conducted on 04/12/2021, 04/14/2021, 04/15/2021, 05/14/2021, and 05/27/2021. A complaint was received by the department on 04/09/2021 regarding allegations in the area of Supervision. The Director was contacted by telephone to initiate the virtual investigation. On 04/15/2021, there were 49 children present and in the care of 15 staff members. Three staff members and a parent were interviewed and the playground was virtually observed. The record of one child was reviewed.
The evidence gathered during the investigation supported one allegation and the complaint was determined to be valid. The violation was documented on the violation notice issued to the program.

Standard #: 8VAC20-780-340-A Complaint related: Yes Description: Based on four interviews and review of documentation, the center failed to ensure the protection of one child when a heavy piece of unsecured equipment fell onto the child, breaking the child?s leg.
Evidence:
1. On 04/05/2021 at approximately 10:20a.m., Child #1 (age 2 years 6 months) was playing outside on the upper playground and was in the care of Staff #1 and Staff #2. Child #1 and another child were playing around a large chalkboard, approximately 4 feet by 4 feet in size, which was leaned up against the building. The other child knocked the chalkboard over and it fell onto the leg of Child #1. The weight of the chalkboard broke Child #1?s tibia and fibula in the lower right leg.
2. The written injury report was completed by Staff #1. She documented that the accident occurred at 10:20a.m. on 04/05/2021.
3. Interviews with Staff #1 on 04/12/2021 and 05/27/2021 revealed that while on the playground she saw Child #1 and other children playing near the chalkboard. She saw a child run behind the chalkboard causing it to fall over onto Child #1, knocking him down. She picked up the chalkboard and sat on the ground next to Child #1 to assess him. The child was upset and could not find his calm. She carried Child #1 inside and gave him to the director. She then went to get ice and call the child?s parent.
4. Staff #2 stated in an interview on 04/14/2021 that she was on the other side of the playground and did not see the chalkboard fall but saw that it had landed on Child #1.
5. An interview with the parent of Child #1 on 05/14/2021 revealed that Staff #1 called her and asked that she come to the center to get her child. Staff #1 told her that he had been hurt when a chalkboard fell onto his leg. The parent reported that the child had a broken tibia and fibula.
6. During an interview with the director on 04/12/2021, she reported that the chalkboard had not been secured to the building or the fence since the center had moved from the old school into the new building approximately a year prior. The director stated that the chalkboard was 4 feet by 4 feet in size.Plan of Correction: We removed the chalkboard on the day of incidence.
