Technical Assistance:
Discussed the background check requirements for new household members. Discussed the importance of demonstrating compliance during the Provisional License term.

Comments:
An unannounced focused inspection was conducted today from 9:30am-10:40am with the provider on site. There were 10 children (29 points) present with 2 caregivers. The provider is licensed for 7 children and was therefore over capacity.. One child's file and 1 caregiver/household file were reviewed. The children were engaged in the following: sitting in high chairs, washing hands, playing with puzzles, singing/dancing, being held and sleeping in infant carrier seats. The physical space, attendance records and the Emergency Preparedness Plan were reviewed. There were no medications on site. Areas of non-compliance are identified in the violation notice.
Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice and return it to the department within 5 business days from receipt. Please specify how the deficient practice will be or has been corrected. Please do not use caregiver
names; list caregivers by positions only.
Any plans of correction not received within 5 business days will result in the plans not appearing on the Violation Notice and public website.

Violations:
Standard #: 8VAC20-770-40-D-4
Description: Based on review of household records, the caregiver did not obtain a sworn statement or affirmation of a person 18 years of age and older that began residing in the home.
Evidence:
1. Adult Household Member #1 began residing in the home on 4/13/2024. The
provider did not obtain a current sworn disclosure statement or affirmation from the household member.

Plan of Correction: I'll make sure she will have sworn statement date and signed.

Standard #: 8VAC20-800-40-A
Description: Repeat violation
Based on observation, interview and review of attendance record, the provider did not ensure
that the total number of children receiving care at any one time does not exceed the maximum
licensed capacity of the home.
Evidence:
1. The licensed capacity is 7 children. From approximately 9:30am to 10:40am, the provider
was over capacity with 10 children in care.
2. At approximately 9:30am, the provider stated she had 9 children in care. At
approximately 10:12am, a 10th child was found in a separate area behind a closed door in a
storage room in the basement. The provider stated she was aware she had 10 children in
care.

Plan of Correction: I'll have 7 children under my care from now on. It's not a store room, it's a library room, we have books and learning materials in there.

Description: Repeat Violation
Based on review of the attendance record and interview, the family day home did not keep a
written record of children in attendance each day.
Evidence:
1. At approximately 9:30am, there were 10 children in care but only six children were
listed on the attendance sheet. The provider confirmed the four children not on the
attendance sheet arrived at approximately the following times:
Child #7-8:40am, Child #8-8:40am,
Child #9-8:15, Child #10-8:15.

Plan of Correction: I'll make sure to have the attendance record with each child's name.

Standard #: 8VAC20-800-60-A
Description: Repeat Violation
Based on interview, the provider did not maintain an up-to-date record at the family day
home for each enrolled child.
Evidence:
1. The provider did not have records for Child 7, Child 8 and Child 10. The children were in
attendance on 5/07/2024.

Plan of Correction: I'll make sure from now on to have each child's folders up to date.

Description: Repeat Violation
Based on interview, the provider did not provide in writing to the parents the required
information in this section before the child's first day of attendance,
Evidence:
1. The parents of Child 7, Child 8 and Child 10 did not receive the required information before the child's first day of attendance. The children were in attendance on 5/07/2024.

Plan of Correction: I'll make sure each parent will have the required information.

Standard #: 8VAC20-800-90-A
Description: Repeat Violation
Based on interview, the provider did not obtain documentation that the child has been
adequately immunized according to the requirements of Section 32.1-46 A of the Code of
Virginia and applicable State Board of Health regulations before a child may attend the family
day home.
Evidence:
1. Child 7, Child 8 and Child 10 did not have immunization records with the provider and were in attendance on 5/07/2024.

Plan of Correction: I'll make sure to have each child's documentation with the adequately immunized records.

Standard #: 8VAC20-800-170-A
Description: Repeat Violation
Based on observation and interview, the provider did not obtain from each adult household member prior to coming into contact with children a current Report of Tuberculosis Screening form published by the Virginia Department of Health or a form consistent with it documenting the absence of tuberculosis in a communicable form.
Evidence:
1. Household Member #1 began to reside in the home on 4/13/2024 and did not have a current report of tuberculosis screening or test on file.

Plan of Correction: She is in the process of having the TB test results.

Standard #: 8VAC20-800-520-A
Description: Based on observation, cribs were not provided for children from birth through 12 months of age.
Evidence:
1. Child #2 (3 month old) was sleeping in a infant carrier seat from approximately 9:30am to 10:12am.

Plan of Correction: I'll make sure the baby will sleep in the crib from now on.

Standard #: 8VAC20-800-540-A
Description: Repeat Violation
Based on observation and interview, high chairs were not being used to the manufacturer's instructions
and when occupied by a child, a safety strap was not being used and securely fastened.
Evidence:
1. At approximately 9:30am, Child #1 (35 month old) was observed standing up and down in a high chair without a safety strap on or tray. The provider stated she was in the process of taking the child out of the highchair when she left to go answer the door.

Plan of Correction: I'll make sure to have the child with the safety strap securely fastened.

Standard #: 8VAC20-800-560-A
Description: Based on observation and interview, a caregiver did not meet all direct care and supervision requirements of each child..
Evidence:
1. From approximately 9:30am to 10:12am, Child #2 (3 month old) was sleeping in an
infant carrier in a separate storage area of the basement not within sight of the caregiver. The caregiver was not near enough to intervene if needed and was not providing direct care and supervision.
2. The caregiver stated she was only caring for 9 children, however she was caring for 10 children. The provider was unaware of how many children she was caring for, until Child #2 was heard crying in the storage area..

Plan of Correction: I'll make sure to check on the baby constantly.
