Technical Assistance:
Ratios for children 16 months of age and older may be doubled during rest period.
Infant ratios remain 1:4 at all times and may not double during rest period.
When ratios are doubled for children 16 months and older during rest period, there must be additional staff in the building to meet the regular ratios who are within the building and available to ensure safe evacuation in an emergency and an additional person must be present at the center to help, if necessary.
Staff shall be counted in the required staff-to-children ratios only when they are directly supervising children - meaning that the children are in direct sight and sound supervision of the assigned staff at all times.This includes the rest period.

Comments:
An unannounced monitoring inspection was conducted on 12/10/19 from 12:00 p.m. until 2:10 p.m.to review the requirements for Licensed Child Day Centers.
At the time of entrance, the following adult to child ratios were observed:
15 children ages 23 months to 3 years old, with 2 staff during nap time.
The records sample size consisted of 5 children?s records and 6 staff records. Children were observed resting quietly at nap time, and playing quietly on cots. Infants were observed sleeping and having an afternoon snack. Posted information as well as written information for parents was reviewed. All areas used by the children in care were inspected. Transportation was not observed during the inspection. However, standards regarding transportation were reviewed Areas of non-compliance are identified on the violation notice. Violations:
Standard #: 22VAC40-185-70-A
Description: Based on a review of records and interview, the center did not ensure that two or more references as to character and reputation as well as competency were checked before a new staff begins employment or volunteering.
Evidence:
One new staff record was reviewed during the inspection.
The record for staff #1, whose date of employment was documented in the record as 9/16/19, did not contain two or more references as to character and reputation as well as competency.
Staff #3 was unable to locate these written references for staff #1, but stated that she obtained them at the time of hire.

Plan of Correction: Staff #3 stated that she will try to locate the written references obtained at the time of hire and will obtain new references if she is not able to locate the original references within 10 days.

Standard #: 22VAC40-185-260-A
Description: Based on a review of records and interview, the facility did not ensure that an annual fire inspection report from the appropriate fire official having jurisdiction is provided.
Evidence:
The most recent fire inspection available for the center was dated 8/25/18.
Staff #4 stated that a more recent inspection was not available and that she was not aware that she needed to request the inspection annually.

Plan of Correction: Staff #4 stated that she would contact the fire Marshall's office today to request that a new inspection be conducted within 30 days.

Standard #: 22VAC40-185-350-C
Description: Based on observation and interview, the center was not in compliance with the ratio requirements applicable to the youngest child in care for children in mixed age groups at the time of inspection.
Evidence:
At 12:00 when the inspector arrived there were 15 children, ages 8 months old to 3 years of age resting during nap time.
There were 4 infants in the infant room with 1 staff.
There were an additional 11 children, ranging in age from 18 months old to 3 years old sleeping on cots with one additional staff.
The ratio for the youngest child (18 months old) in the group of 11 children is 1:5, which may be doubled during rest time (1:10)
A third staff arrived at 1:00 bringing the ratio into compliance for rest period.

Plan of Correction: Staff #3 stated that she was unaware that the ratios for infants could not be doubled during nap time and allowed staff to leave for their lunch breaks thinking that ratios would be met during rest period.
Staff #3 stated that, effective immediately, she will schedule staff lunch breaks to ensure that staff to child ratios are met at all times for each age group to include mixed age groups based on the youngest child in the group.
