Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.
A monitoring inspection was initiated on 09/08/2020 and concluded on 09/09/2020. A self-reported incident was received by the department by the department regarding allegations in the areas of supervision. The director was contacted by telephone to conduct the investigation. The inspector emailed the director a list of the documentation required to complete the investigation.
The evidence gathered during the investigation supported the self-report of non-compliance with standards or law and violations were issued. Any violation not related to the self-report but identified during the course of the investigation can be found on the violation notice.

Violations:
Standard #: 22VAC40-185-40-E
Description: Based on review of policies and procedures required of these standards, the licensee did not demonstrate operational responsibility for staff following the center's policies and procedures. Evidence: 1. The center's policy states, "Your child will be supervised at all times." "Our teachers conduct name-to-face roll calls throughout the day saying each child's name and making eye contact to be sure everyone is accounted for." 2. On September 3, 2020, staff #2 and staff #3 left child #1 at the center playground unsupervised when the staff and remaining children went inside.

Standard #: 22VAC40-185-340-A
Description: Based on interview, center staff failed to ensure care, protection, and guidance to a child they were supervising. Evidence:
1. On 09/03/2020, staff #1 and staff #2 left a 2 year old child (child #1) on a playground unattended for approximately 4 minutes. 2. Staff #3 was on an adjacent playground and saw child #1 alone on the playground and took her inside. 3. Staff #1 stated "I thought she had been picked up." and that communication in the evening is "terrible".

Standard #: 22VAC40-185-340-F
Description: Based on interviews, the center staff failed to have a child under the age of 10 years of age within actual sight and sound supervision. Evidence:
1. Staff #1 reported that child #1 was left unattended by staff on the fenced playground. 2. Staff #1 stated that the child's staff and class went inside leaving child #1 alone on the playground at 4:52 p.m. and another staff person, staff # 4 got the child from the playground at 4:56. 2. Staff #5 reported that she was in the center and that the mother of child #1 called to say she was on her way to pick up child #1. Staff #5 then asked staff to bring the child to be picked up and staff #2 reported to her the child had already been picked up. Staff # 4 who was on the adjacent playground saw the child standing alone by the play structure and brought the child inside. Child #1 was not within actual sight and sound supervision for approximately 4 minutes. 3. Staff #2 stated they came back in from the playground at approximately 4:50.

Standard #: 22VAC40-185-350-C
Description: Based on interview, the center did failed to maintain required staff to children ratios when children are in care.
Evidence:
1. Staff #1 and staff #2 stated they had a total of 20 children on the playground and that the ages were from 2 years of age (4 total) through five years of age. 2. Staff #3 stated that the "the 2 yr. olds and 5 year olds were fighting so we decided to go inside". 3. Staff #5 stated she was not told the staff on the playground had 2 year olds in their care.
