Comments:
A complaint inspection was initiated on January 8, 2024 from 3:30 P.M.-4:30 P.M. on site, and concluded on January 10, 2024 after review of documentation. A complaint was received in the Office of Child Care Health and Safety (Valley) on December 15, 2023 regarding administration, and staff qualifications and training. The inspector reviewed compliance in the areas of administration, staff qualifications and training, staffing and supervision, physical plant, special care provisions and emergencies, physical plant and required postings. Three staff were interviewed, attendance records, and five staff records were reviewed.

The information gathered during the investigation supports parts of the allegation, therefore the complaint is determined to be "valid". Please complete the columns for "description of action to be taken," and "the date to be corrected" for each violation cited on the violation notice. Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Based on a review of staff records, the center failed to ensure that documentation of a tuberculosis screening shall be submitted at the time of employment and prior to coming into contact with children.

Evidence:
1. Staff #1's date of hire was 11/14/2023. There was no documentation in the record of a tuberculosis screening being completed.
2. Administration verified that on 12/01/2023 Staff #1 was working on site and with children, and that there was no tuberculosis screening documentation in the record.

Plan of Correction: Future hires will have a tuberculosis screening prior to coming into contact with children.

Based on review of staff records, the center failed to obtain two or more references as to character and reputation as well as competency were checked before employment.

Evidence:
1. Staff #1's date of hire was 11/14/2023. There was not documentation of two references in the staff record.
2. Administration verified the date of employment, and that there were no references in the staffs record.

Plan of Correction: All references will be required before start date.

Description: Based on a review of staff records, the center failed to ensure that the Virginia Department of Education sponsored or orientation course shall be completed within 90 calendar days of employment.

Evidence:
1. Staff #2's date of hire was 09/13/2023. There was not documentation of the orientation course being completed. The orientation course was required to be completed by 12/13/2023.
2. Administration verified with Staff #2 that the orientation had not been completed.

Plan of Correction: Preservice Training will be completed by the 60th day of employment.

Description: Based on review of time cards, staff records, and interview, the center failed to ensure there shall always be at least one staff ember on duty who has obtained within the last three years instruction in performing the daily health observation of children.

Evidence:
1. On 12/01/2023 from 2:30 P.M.-6:00 P.M. there were no staff on site that had completed the Daily Health Observation Training.
2. Administration verified the staff on site on 12/01/2023, and the times each staff member worked.
3. There was no documentation in the staff records for Staff #1, #2, #3, and #4 that the Daily Health Observation training had been completed.

Plan of Correction: All staff will obtain the Daily Health Observation training.

Based on review of staff records, and interview, the center failed to ensure that during the stated hours of operation, there always shall be on the premises when one or more children are present one staff member who meets the qualifications of a program leader.

Evidence:
1. On 12/01/2023 from 2:30 p.m. to 4:00 p.m., Staff #1, #2, and #3 were supervising 24 children ages 5 through 12 years of age. Staff #1, #2 and #3 did not have documentation of meeting qualifications of a program leader in their staff records.
2. Staff #1 did not have the experience or training required to be a program leader.
3. Staff #2 and #3 did not have the required training hours to be a program leader.

Plan of Correction: All staff will obtain required training to become Program Lead.
