22.1 EARLY CHILDHOOD CARE AND EDUCATION

Comments:
A renewal inspection was conducted today, February 8, 2024. The inspectors were on site from approximately 10:00 am until 1:00 pm. The site director was present during the inspection. There were eight children present, ranging in ages from three years to five years, with three staff supervising. Upon the Inspector?s arrival, children were having circle time. Children also played with trains and a farm playset. Later children had snack. Staff read stories to the children while they ate their snack. Children had time on the playground where they played with the parachute and balls.
The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition. A total of five child records and six staff records were reviewed.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

The violation notice for this inspection was amended on 02/15/2024.

Standard #: 22.1-289.035-B-2
Description: Based on a review of six staff records and interview, the center did not ensure one staff
member completed a national fingerprint check prior to the first day of employment and within
the required time frame.

Evidence:

1. The national fingerprint check for Staff #4, hired on 01/03/2024, was dated 01/25/2024
exceeding the first day of employment.
2. The director acknowledged the fingerprints background check was not completed prior to employment.

Plan of Correction: Per the director: Going forward fingerprints background checks will be completed prior to employment.

Standard #: 22.1-289.035-B-4
Description: Repeat
Based on review of six staff records, the center did not obtain the results of a criminal
history record information check and a search of the child abuse and neglect registry or equivalent registry from any state in which one staff member had resided in the preceding five years.

Evidence:

1. The record for Staff #2, employed 09/07/2023, indicated the staff had resided in
three additional states outside of Virginia within the last five years.
2. The record for staff #2 did not contain a criminal history record information check or a search of the child abuse and neglect registry for the state of Washington.
3. The record for staff #2 did not contain a criminal history record information check or a search of the child abuse and neglect registry for the state of Pennsylvania.
4. The record for staff #2 did not contain a criminal history record information check, or a search of the child abuse and neglect registry for the state of Texas.
5. The out-of-state criminal history record information check is required to be obtained prior to hire. The out-of-state search for founded complaints of child abuse or neglect is required to be requested within the first 30 days of being employed.
6. The director confirmed the required out-of-state background checks for each state were not requested for Staff #2.

Plan of Correction: Per the director:
2. The criminal history and abuse and neglect links have been forwarded to staff #2 for competition on 02/08/2024. Awaiting results from Texas.
3. The criminal history and abuse and neglect links have been forwarded to staff #2 for competition on 02/08/2024. Awaiting results from Pennsylvania.
4. We've reached back out to Texas on 02/08/2024 for status on request submitted in October .
5. Out of state criminal history check will be made prior to hire going forward. the child abuse and neglect will be checked within the first 30 days

Standard #: 8VAC20-770-60-B
Description: Based on review of six staff records, the center did not obtain a completed sworn statement
prior to the 1st day of employment and no more than 90 days prior to employment for one staff member.

Evidence:

1. The record of staff #4, employed 01/03/2024, contained a sworn statement dated 08/23/2023 exceeding the 90 days prior to the day of employment.
2. The director stated employment was postponed for staff #4 and up-dated sworn statement was not completed.

Plan of Correction: Per the director: We will receive the sworn statement by 02/14/2024 and will upload for search completion.

Standard #: 8VAC20-770-60-C-2
Description: Based on review of six staff records and interview, the center did not obtain the results
of a central registry background report within 30 days of employment and no more than 90 days prior to employment for one staff member.

Evidence:

1. The record of staff #4, employed 01/03/2024, contained the results of a central registry
background check dated 06/14/2023 exceeding 90 days from employment.
2. The director stated employment was postponed for staff #4 and a current central registry check was not requested.

Plan of Correction: Per the director: Director has initiated background check and will receive signed sworn statement 02/14/2024 and will upload for search completion.

Standard #: 8VAC20-780-160-A
Description: Repeat
Based on review of six staff records, the center did not obtain documentation of a
negative tuberculosis screening for one staff member within the required time frame.

Evidence:

1. The record for staff #4, employed 01/03/2024, contained documentation of a
negative tuberculosis screening dated 01/23/2024 exceeding the date of employment.
2. Tuberculosis screenings are required to be completed no more than 30 calendar days prior to employment and submitted at the time of employment.

Plan of Correction: Per the director: Going forward the director will ensure TB screening is received no more than 30 days prior to employment and submitted at time of employment.

Standard #: 8VAC20-780-240-A
Description: Based on review of six staff records, the center did not ensure staff completed the Virginia Department of Education sponsored orientation course within 90 calendar days of employment.

Evidence:

1. The record of staff #3, employed 08/29/2023, contained documentation of competing the Virginia Department of Education orientation course on 12/03/2023, exceeding 90 days from employment.
2. The record of staff #6, employed 07/02/2023, contained documentation of competing the Virginia Department of Education orientation course on 01/29/2024, exceeding 90 days from employment.

Plan of Correction: Per the director: Director will review and monitor staff completion within 90 days hence forth.

Standard #: 8VAC20-780-280-B
Description: Based on observation, the center did not ensure hazardous substances such as cleaning materials were kept in a locked place using a safe locking method that prevents access by children in care.

Evidence:

1. A spray container of sanitizer was observed on the shelf in the four-year-old classroom.
2. A spray container of sanitizer was observed on a low shelf in the bathroom off the playground used by children in care.

Plan of Correction: Per the director: The spray container of sanitizer in the 4 year old classroom is now in the locked closet. The sanitizer in the playground bathroom has been removed and placed in a cabinet with lock.

Standard #: 8VAC20-780-510-L
Description: Based on observation and interview, the center did not ensure medication, except for those prescriptions designated otherwise by a written physician?s order, were kept in a locked place using a safe locking method that prevents access by children.

Evidence:

A prescription medication for child #1 was observed in a zipper bag, inside a tote bag hanging on the back of the classroom door where children were present. The director acknowledged the bag was not locked and was kept in the tote for easy access on the playground if needed.

Plan of Correction: Per the director: A lock has been placed on the bag and staff have been advised of the combination.
