An unannounced non-mandated monitoring inspection was conducted April 14, 2023 and concluded May 11, 2023. The non-mandated monitoring inspection was in response to a self-reported incident regarding allegations in forbidden actions on April 13, 2023. Interviews were conducted and documents were reviewed.
There were violations related to the self-reported incident. Any violations not related to the self-report but identified during the course of the investigation can be found on the violation notice.
Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice and return it to me within 5 business days from today. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measures. Please do not use staff names; list staff by positions only.

Standard #: 8VAC20-780-40-E Description: Repeat Systemic Violation
Based on a review of records and staff interviews, the licensee failed to ensure that the center's activities, services, and facilities are maintained in compliance with the center's own policies and procedures that are required by these standards.
Evidence: 1. Page 5 of the center's unacceptable and acceptable discipline policy titled, "Respect and Protect Children," states "certain discipline methods are simply not acceptable at KCE, including: grabbing."
2. In an interview on 05/01/2023, staff #1 stated that on 04/13/2023, she witnessed staff #2 grab child #1 by the right wrist and pull the child backwards and to the ground, adding that the child screamed after it happened.
3. An incident report, completed by staff #1 and signed by staff #3 dated 04/13/2023, indicated that child #1 "was grabbed on the wrist and was pulled down to the ground."Plan of Correction: Continue to train staff on positive guidance. Daily check-ins will be done on staff's well being. Review policies periodically.
Standard #: 8VAC20-780-410-1 Description: Repeat Violation
Based on document review and staff interviews, the center failed to ensure that roughly handling a child is forbidden.
Evidence: 1. In an interview on 05/01/2023, staff #1 stated that on 04/13/2023 she witnessed staff #2 grab child #1 by the right wrist and pull the child backwards and to the ground, during circle time. Staff #1 stated the pull was "forceful" and child #1 screamed after it happened.
2. An incident report, signed by staff #3 and dated 4/13/2023, stated child #1 "was grabbed on the wrist and was pulled down to the ground."
3. Staff #4 confirmed that staff #2 was terminated as a result of the incident on 04/13/2023.Plan of Correction: Terminated staff #2. Reminded all staff of policies and procedures.
