An unannounced non-mandated monitoring inspection was initiated on October 16, 2023 and concluded December 8, 2023. The non-mandated monitoring inspection was in response to a self-reported incident regarding allegations in programs that occurred on October 16, 2023. Interviews were conducted and documents were reviewed.
The evidence gathered during the investigation supported the allegation of non-compliance with standards or law and violations were issued. Any violations not related to the self-reported but identified during the course of the investigation can be found on the violation notice.
Please complete the plan of correction and date to be corrected for each violation cited on the violation notice and return it to me within 5 business days from today. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measures. Please do not use staff names; list staff by positions only.

Standard #: 8VAC20-780-40-E Description: Repeat Violation
Systemic Violation
Based on a review of documents and staff interviews, the licensee failed to ensure that the center's activities, services, and facilities are maintained in compliance with the center's own policies and procedures that are required by these standards.
Evidence: 1. The center?s policy titled ?Guidance, Protection of and Respect for Children,? states ?employees are required to use positive guidance techniques and to refrain from any unacceptable measures while caring for children on behalf of the company. Employees are expected to use a calm, caring and gentle tone of voice and to never use a harsh tone of voice.?
2. Interviews on November 16, 2023, with staff #2 and #3 indicated that on October 16, 2023, they witnessed staff #1 yell in the face of child #1 (age 1 year), resulting in the child crying.Plan of Correction: Staff meeting held to retrain on KinderCares Respect & Protect children's policy, which includes acceptable and unacceptable positive child guidance. Training certificate in each employee's file. Staff retrained on mandated reporting. Program Director will have monthly staff meetings to discuss quality of care, inclusion connection resources/tools for managing challenging behaviors, and building teacher-child relationships.
Standard #: 8VAC20-780-400-B Description: Repeat Violation
Based on interviews and document review, the center failed to ensure behavioral guidance is constructive in nature, age and stage appropriate, and shall be intended to redirect children to appropriate behavior and resolve conflicts.
Evidence: 1. In an interview with staff #2 on November 16, 2023, it was reported that on October 16, 2023, staff #2 witnessed staff #1 get in the face of child #1 (age 1 year) and ?yell with an aggressive voice? at child #1, who began crying afterward.
2. In an interview with staff #3 on November 16, 2023, it was reported that on October 16, 2023, staff #3 heard staff #1 ?yell with an angry voice? at child #1 (age 1 year). Staff #3 reported she witnessed staff #1 really close to child #1?s face when yelling.
3. Documentation of an email to families states that staff #1 was terminated.Plan of Correction: Program director will choose a classroom each week to model appropriate behaviors based on KinderCare's respect & protect children's policy as well as conduct ongoing in the moment coaching of staff.
