Technical Assistance:
The following need to be received before you can hire someone:

1. fieldprint fingerprint results
2. completed sworn statement
3. if the person has lived outside of VA within the past 5 years you need their out-of- state criminal background search results and the sex offender registry search results from any state they have resided in.

You do not need the social services child abuse and neglect search (Virginia or out-of- state) back before hire - they just need to be received by the end of their 30th day of employment for the VA one and 45 days for any out-of-state ones.

Also, if someone has resided out-of-state in the past 5 years, if that state is highlighted in red (NFF State) on the out-of-state background check contact sheet you do not have to complete the criminal background search for that state but you do still have to complete the sex offender registry search and the child abuse and neglect registry search. If the state is listed in black, you have to complete all three.

Comments:
A renewal inspection was initiated and concluded on 4/26/2023. There were 48 children, ages 3 and 4 years old, present with 6 staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition. A total of 5 child records and 5 staff records were reviewed. The inspection started at 10:50 am and concluded at 12:25 pm.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 22.1-289.035-B-4
Description: Based on a review of records and interview, the licensee did not ensure that results of a criminal history record information check, a sex offender registry check, and a search of the child abuse and neglect registry or equivalent registry are obtained from any state in which the individual staff has resided in the preceding five years.

Evidence:
Three staff records were reviewed during this inspection.
The record for staff #1 contained documentation that staff #1 resided in Connecticut within the past 5 years.

The record for staff #1 documented staff #1's date of employment as 6/6/2022.

Staff #1's record contained a copy of the request for a Criminal Record Check for Connecticut , which was sent 2.27.2022, but did not contain the results of the search. The Criminal Record check results are required prior to staff being employed.

The record for staff #1 contained the results of an abuse and Neglect registry search for Connecticut which was dated 3/8/2023. The results of the abuse and neglect registry search are required within 45 days of employment.

Plan of Correction: The program director will require out of state Criminal Records Search results prior to employing new staff and follow up on out of state Central registry search results within 30 days if they are not received.
Contact will be made with the Connecticut agency to follow up and obtain the results of the Criminal Record search for staff #1 by the end of the week and any necessary steps to obtain these results will be taken and documented in the record.
