22VAC40-185 SPECIAL CARE PROVISIONS AND EMERGENCIES.
An unannounced complaint investigation was conducted on 4/23/18 from 10:05am-11:10am, in response to a complaint received by our office [on 4/19/2018] alleging that ratios and emergency procedures in the event of a child's injury were not met. The playground equipment was inspected, interviews of staff were conducted and video footage was reviewed. There was not a preponderance of evidence to support the allegations; therefore, this complaint has been deemed not valid/founded. However, other areas of noncompliance were found and are outlined in the violation notice. Standard #: 22VAC40-185-330-A Complaint related: No Description: Based on observation, the playground was not designed to protect children from hazards. Evidence: After thorough inspection of the toddler playground, a large, jagged rock embedded in the ground at the end of a slide was exposed approximately two inches above the resilient surfacing [mulch] and approximately 6 inches in diameter. Plan of Correction: The large, jagged rock/concrete was chipped off during surface installation on May 8th, 2018. A significant amount of mulch has been added on the same day.
Standard #: 22VAC40-185-550-M Complaint related: No Description: Based on a review of records, 2 injury reports did not include the required information. Evidence: An injury report [dated 4/18/18] was missing future preventative actions; An injury report [dated 4/2/18] was missing time of injury and the date/time parent was notified. Plan of Correction: Enforce teachers to correctly fill out all accident reports.
