Comments:
An unannounced complaint inspection was conducted on April 6, 2018, April 13, 2018 and completed on May 7, 2018 in regards to a complaint received on April 2, 2018. A joint investigation was conducted with a local agency. Children's records, staff records, documentation regarding policies and procedures, Face-to-Name logs, attendance records and the physical space outside were reviewed. Additional interviews were conducted with staff and parents. The preponderance of evidence gathered during the investigation supports the allegation regarding supervision. Standard #: 22VAC40-185-40-E
Complaint related: No
Description: Based on staff interviews and review of documentation, the center failed to follow it's own policies and procedures for supervision. Evidence: 1) On April 2, 2018, Staff #1 and Staff #2 were supervising a combined age class, at approximately 4:20pm, on the playground. The playground was "L" shaped. 2) Staff #1 and Staff #2 were playing basketball on one side of the "L" playground. Child A and Child B, both 3 years old, were out of site from the Staff members, on the other side of the "L" playground. 3) Staff #1 and Staff #2 failed to follow their own Playground Safety policies regarding anticipating children's movements, zoning for proper visual supervision on L shaped playgrounds and keeping a direct line of supervision at all times.

Plan of Correction: Both staff members have been retrained on the policies and procedures for playground supervision.

Complaint related: No
Description: Based on interviews, staff supervising children did not always ensure their care and protection. Evidence: 1) On April 2, 2018, Staff #1 and Staff #2 were supervising a combined age class, at approximately 4:20pm, on the playground. The playground was "L" shaped. 2) Staff #1 and Staff #2 were playing basketball on one side of the "L" playground. Child A and Child B, both 3 years old, were out of site from the Staff members, on the other side of the "L" playground. 3) A parent in the parking lot, on the opposite side of the building to where Staff #1 and Staff #2 were playing basketball, observed Child A and Child B push on the first of two gates to lead to the parking lot. The first gate leads to a pathway in front of the center and was approximately 15 yards from a second gate, which leads to the parking lot. The parent observed the children push the first gate open and then retreat to the playground after being seen by that parent. 4) The director observed the parent standing out front and proceeded out the front door to see what the parent was watching . The parent motioned to the children and the gate, as the children retreated. 5) The director walked towards the gate, and playground, from the front of the building. 6) The children did not open the second gate that lead to the parking lot.

Plan of Correction: Both staff members have been retrained on proper supervision to ensure the children are kept safe.

Description: Based on interviews, the center failed to have two children under 10 years of age within actual sight and sound supervision of staff. Evidence: 1) On April 2, 2018, Staff #1 and Staff #2 were supervising a combined age class, at approximately 4:20pm, on the playground. The playground was "L" shaped. 2) Staff #1 and Staff #2 were playing basketball on one side of the "L" playground. Child A and Child B, both 3 years old, were out of site from the Staff members, on the other side of the "L" playground. 3) A parent in the parking lot, on the opposite side of the building to where Staff #1 and Staff #2 were playing basketball, observed Child A and Child B push on the first of two gates to lead to the parking lot. 4) Child A and Child B were not within actual site and sound supervision of Staff #1 and Staff #2.

Plan of Correction: Both staff members have been retrained to keep all children within sight and sound.
