22VAC40-191 Background Checks (22VAC40-191)

Technical Assistance:
Inspector spoke with the Director about updated background check regulations during this inspection.

An unannounced inspection was conducted from 11:30am to 1:30pm. At the time of entrance, there were 50 children present with 8 staff present and 1 administrator. The inspector observed children participating in instructional time, free play and infant activities, lunch, toileting and hand washing. A sample size of 6 children's records and 5 staff records were reviewed. No medications are being administered. Injury reports were also reviewed. Areas of noncompliance are identified in the Violation Notice and were discussed with the Director at the conclusion of this inspection.

Standard #: 22VAC40-185-270-A
Description: Based on observation it was determined the center did not ensure that all areas and equipment of the center, inside and outside, were maintained in a clean, safe and operable condition. Evidence: In the infant building there was a piece of base board molding missing and another piece that was separated from the wall 1/2" creating a potential pinch point. There was also a small finishing nail in the loose baseboard that was protruding 1/4" and was easily pulled out presenting a potential choking and injury hazard.

Plan of Correction: The nail was removed during the inspection and the base board will be secured and replaced.

Standard #: 22VAC40-185-330-B
Description: Based on observation it was determined that the center did not ensure that there was resilient surfacing under all equipment with moving parts or climbing apparatus to create a fall zone free of hazardous obstacles. Evidence: There was not adequate resilient surfacing around the outdoor play equipment's 3 slides. The fall zones for each slide contained grass/weeds which affect the impact attenuation of the resilient surfacing.

Plan of Correction: All grass and weeds will be removed from the required fall zones.

Standard #: 22VAC40-185-450-A
Description: Based on observation it was determined that the center did not ensure that all children had a top and bottom cover when using a cot. Evidence: Child #7 did not have a bottom cover on their cot.

Plan of Correction: A bottom cover was put on the cot during this inspection.

Standard #: 22VAC40-185-550-D
Description: Based on record review and interview it was determined the center did not practice the required minimum of two shelter-in-place practice drills per year for the most likely to occur scenarios. Evidence: The center only had documentation of one shelter-in-place practice drills this year. Staff confirmed that another drill needed to be done.

Plan of Correction: The center will perform and document a minimum of two shelter-in-place practice drills per year for the most likely to occur scenarios.
