Comments:
The licensing inspector completed an inspection in response to a self-reported concern regarding forbidden action. The Department was notified of the incident on 05/18/2018. On 05/21/2018, the licensing inspector was on site from approximately 11:50 AM until 2:35 PM interviewing staff, conducting observations at the center, and reviewing documentation. On 05/25/2018, the licensing inspector conducted additional interviews. The preponderance of the evidence gathered during the investigation supports areas of noncompliance with the licensing standards related to forbidden action. Please complete the 'plan of correction' and 'date to be corrected' for each violation cited on the violation notice and return it to me within 5 business days from date of receipt. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standards, 2) measures to prevent the noncompliance from occurring again, and 3) person(s) responsible for implementing each step and/or monitoring any preventative measure(s). Violations:
Standard #: 22VAC40-185-40-E
Description: Based on six staff interviews and documentation review, the center did not maintain compliance with their own policies and procedures required by standards.
Evidence:
During the 05/21/18 inspection, the following was determined:
1. Staff stated Staff #1 has roughly grabbed children in the Toddlers classroom (16 to 24 months of age) by their wrist and "dragged" and ?slammed? children into chairs to make children sit. Staff stated Staff #1 would make comments such as ?this child needs a whooping? and ?this child gets on my nerves?. Staff also stated Staff #1 would tell children she was going to "break off their fingers? if children would pinch, or she was going to "pull the children?s teeth out? if children would bite.
2. The ?Positive Discipline and Child Dismissal? center policy states the following: "Under no circumstance is any form of abuse, physical punishment, deprivation or ridicule to be used as a form of discipline?. The ?Dealing With Difficult Children? center policy states ?Know that as responsible, mandated reporters, we must never be physical with any child, speak in a demeaning way or inflict emotional damage?.

Plan of Correction: Staff #1 was placed on leave and is now no longer employed at COA. Company policies regarding positive discipline will be reviewed at a staff meeting on 06/14/18. Director responsible.

Standard #: 22VAC40-185-400-B
Description: Based on interviews and documentation review, the center did not ensure behavioral guidance was constructive in nature, or age and stage appropriate. Evidence: During the 05/21/18 inspection, the following was determined: Three staff interviewed stated the following: 1. ?I have heard [Staff #1] say ??this child needs a whooping??, ??this child gets on my nerves?? and ??they are too much?? at least five times a day to some of the children enrolled in the Toddler classroom (children 16 to 24 months of age). I have seen this going on for the last few weeks. 2. ?I am concerned by the way [Staff #1] talks to the kids. [Staff #1] would talk to the children in loud, harsh tones. [Staff #1] would say to [Child A] loudly ??you get on my nerves??. I would hear [Staff #1] say these things often, but it got worse about two weeks ago, saying it three to four times a day. 3. ?Since the beginning of May 2018, I have noticed [Staff #1] having a harsh tone with the Toddlers. I have heard [Staff #1] tell crying children ??Shut your mouth??.

Plan of Correction: Staff #1 was placed on leave and is now no longer employed at COA. Behavioral guidance will be reviewed at a staff meeting on 06/14/18. Director responsible.

Standard #: 22VAC40-185-410-1
Description: Based on interviews and documentation review, the center did not ensure the forbidden action of roughly handling a child did not occur.

Evidence: During the 05/21/18 inspection, the following was determined:
Three staff interviewed stated the following:
1. ?I have seen [Staff #1] have aggression towards the Toddler children. [Staff #1] would roughly grab children by the upper arm by the shoulder area and 'slam' children down in chairs. This would often happen during lunch and snack time if the children tried to get up. Most recently (about a week ago), I saw [Staff #1] drag [Child B] back to the chair after [Child B] got out of the chair. [Staff #1] dragged [Child B] back to the chair by the wrist and slammed [Child B] back into the chair. [Child B] was crying when this happened.?
2. "About two weeks ago, I saw a child (don?t remember which child) had an altercation with another child. [Staff #1] went over to the child and picked the child up by the waist and placed the child roughly in the chair. The child was crying.?
3. ?About the second week of May, I saw [Staff #1] pick up a child up under the arms and slam them in a chair."
4. Staff # 5 (a member of management) stated on 5/14/18, three staff members stated they were concerned with the interactions of Staff #1 with the Toddler children. Staff #5 stated she requested the staff members to submit written statements stating their observations and concerns with Staff #1. A copy of those statements were provided to the licensing inspector.

Plan of Correction: Staff #1 was placed on leave and is now no longer employed at COA. Licensing standards/policies regarding forbidden actions will be reviewed at a staff meeting on 06/14/18. Director responsible.

Standard #: 22VAC40-185-410-6
Description: Based on interviews and documentation review, the center did not ensure verbal remarks which are demeaning to the child did not occur.

Evidence: During the 05/21/18 inspection, the following was determined:
Two staff interviewed stated the following:
1. "Toddlers sometimes bite. If one of the children in the classroom bites, [Staff #1] would say 'do you want me to pull your teeth'".
2."A couple of the children really seemed to get on [Staff #1] nerves. [Staff #1] would say to the children 'I?m going to break your fingers or pull your teeth' when [Staff #1] felt like the children were not behaving. The children would sometimes begin crying. In the last two weeks, it has gotten worse and [Staff #1] would say things like this several times a day."
3. Staff # 5 (a member of management) stated on 5/14/18, three staff members stated they were concerned with the interactions of Staff #1 with the Toddler children. Staff #5 stated she requested the staff members to submit written statements stating their observations and concerns with Staff #1. A copy of those statements were provided to the licensing inspector.
