Comments:
The licensing inspector conducted an unannounced monitoring inspection on Tuesday, September 04, 2018 and Thursday, September 06, 2018 in response to a self-reported incident that the Department received on August 27, 2018 regarding the care of the children being served by the child day center. The inspector was on site on Tuesday, September 04, from 2:15pm to 3:20pm and on Thursday, September 06, from 11:56am to 1:15pm. Interviews were completed, observations were made in the center, and documentation was reviewed. The preponderance of the evidence gathered during the investigation validates the self-reported incident. Please complete the 'plan of correction' and 'date to be corrected' for each violation cited on the violation notice and return it to me within 5 business days from date of receipt. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standards, 2) measures to prevent the noncompliance from occurring again, and 3) person(s) responsible for implementing each step and/or monitoring any preventative measure(s). Standard #: 22VAC40-185-560-D
Description: Based on interview and documentation review on 09/04/2018 and on 09/06/2018, it was determined that the center did not ensure drinking water or other beverage not containing caffeine shall be offered at regular intervals to nonverbal children. EVIDENCE: 1) During interview on 9/04/18, the Center Director reported that Staff #1, Staff #2, Staff #3, and Staff #4, were terminated from employment on 08/24/2018 as a result of not ensuring drinking water or other beverage was offered to 12 out of 13 children in the Toddler Room during breakfast, morning snack, lunch, and afternoon snack on 08/20/18, 08/21/18, 08/22/18, 08/23/18, and 08/24/18. 2) In a written statement dated 08/23/2018, a staff member stated that based on video footage reviewed on 08/23/2018?? [at 9:06 am] all children?s milk were taken from them before most finished and thrown in the bucket,? and ..."[at 11:48am] Staff #2 starts giving out milk. She does not give any to the children at Staff #3's table. Only the other 2 tables. She takes cups out of children's hands and throws the cup with milk in them in the bucket," "...Staff #3 never gave the 4 children at her table any milk." 3) During interview on 09/04/18, a staff member stated that based on video footage reviewed during breakfast time on 08/23/2018, one child at the table was given a drink and that "the (other) children were given cups, but immediately picked up." 4) During interview on 9/06/18, a staff member stated that at least 6 out of 14 children enrolled in the Toddler Room are nonverbal. These children were present at the center on 08/20/18, 08/21/18, 08/22/18, 08/23/18, and 08/24/18, when Staff #1, Staff #2, Staff #3, and Staff #4 were observed not providing drinking water or other beverage to the children in care. The children in the classroom were between 16 months old to 23 months old. Drinking water or other beverage not containing caffeine shall be offered at regular intervals to nonverbal children.

Plan of Correction: Per the Director: On August 24th, 2018 it was brought to the director's attention that milk, juice and water cups were not coming into the kitchen from the toddler room. The Director immediately pulled up the videos from prior days and of the 24th and observed the instances that are noted in the "Description of the Violation" by the daycare's licensing inspector. After observing the violation, the Director fired all 4 teachers. The Director then called the daycare's licensing inspector and reported the violation. Future Prevention: New teachers were hired immediately! Training was conducted by the Program Director on September 10th, 2018. Attendance was required by all new and existing teachers. The training was on the regulation pertaining to the violation on August 29th, 2018 and how child abuse and neglect laws pertain to this standard. Training was conducted from 600pm-8:00pm. 22VAC 40-185-(8)-560D The center will ensure drinking water or other beverage not containing caffeine shall be offered at regular intervals to nonverbal children. The staff understands that not complying to 22VAC 40-185-(8)-560D or witnessing another staff member and not reporting is in violation of this standard. They understand that if the Program Director witnesses this violation on prior video that they will be let go and it will be reported to the Virginia Department of Social Services.
