22VAC40-191 Background Checks (22VAC40-191)

An unannounced renewal inspection was completed on 10/18/2018. There were 41 children, ages 7 weeks-4 years, and 8 staff providing direct care and supervision present during today's inspection. The inspector reviewed 5 children's, 5 staff records and 3 medications during today's inspection The children were observed in the following activities: finishing up lunch, during rest time, having an afternoon snack and in free choice play. Proper hand washing, table sanitization and diapering were also observed during the inspection. Infants were observed being fed and allowed to sleep on demand. The inspector reviewed the emergency procedures and emergency supplies during the inspection today. The inspector discussed the following with the site staff: attendance requirements, children's allergies, background check requirements, model forms for subsidy providers, and caring for infants. Standard #: 22VAC40-185-340-D
Description: Based on observation, record review and discussion with the staff, the facility failed to ensure that in each grouping of children at least one staff member who meets the qualification of a program leader or program director shall be regularly present. Evidence: Staff #5 was observed in the role of Program Lead for the Toddler Class during the inspection. Staff #5 does not qualify for the position of Program Lead based on the review of the staff record.

Plan of Correction: The Assistant Director went to the Toddler Room and Staff #5 went into the Infant Room. The center will ensure that anyone in a lead position will have the qualifications for that position.

Standard #: 22VAC40-185-430-I
Description: Based on observations and discussion with the staff, the facility failed to ensure that all personal articles shall be individually assigned. Evidence: 1. There was an unlabeled pink pacifier on the side of the sink in the Toddler Room. 2. There were two unlabeled pacifiers on the counter in the Infant Room.

Plan of Correction: Pacifiers were labeled during the inspection and were placed in labeled baggies.

Standard #: 22VAC40-185-520-A
Description: Based on observations and discussion with the staff, the facility failed to ensure that over-the-counter skin products shall not be kept not or used beyond the expiration date of the product. Evidence: The over-the-counter diaper ointment #6 had an expiration date of 10/2016.

Plan of Correction: Director will view ointments herself in the future.

Standard #: 63.2-1720.1-B-2
Description: Based on record review and discussion with the staff, the facility failed to ensure that no person shall be hired for compensated employment prior to the facility obtaining an employment eligibility letter upon the completion of a fingerprint background check as required by the Code of Virginia. Evidence: The record for Staff #3 has a documented hire date of 07/23/2018; the fingerprint eligibility letter is dated 07/26/2018.

Plan of Correction: No new employee will be hired until proper fingerprint checks are emailed to us.
