22VAC40-191 Background Checks (22VAC40-191)
An unannounced monitoring inspection was conducted on 10/19/2018 from 11:05am until 1:50pm. At the time of the tour, there were 77 children in care with 11 staff present. 8 children's records and 8 staff records were reviewed. Children were observed participating in morning learning activities, playing on the playground and eating lunch. Hand washing and toileting procedures were also observed. Medication, first aid and emergency supplies, the emergency preparedness plan, documentation of emergency practice drills and center postings were reviewed. Two violations in the areas of administration and background checks are identified on the violation notice and were discussed with administrative staff during the exit interview.
Standard #: 22VAC40-185-70-A Description: Based on record review and interview, the center did not ensure that all staff records contain documentation that two or more references as to character and reputation as well as competency were checked before employment. Evidence: 1. The record for staff 2 (hire date: 8/20/18) contains documentation of only one reference, where two are required. 2. Administrative staff confirmed that only one of the two required references were obtained. Plan of Correction: The second reference person for staff 2 did not return administrative staff's call. Another reference person will be obtained from staff 2 and documentation of the reference check will be placed in staff 2's record.
Standard #: 63.2-1720.1-B-2 Description: Based on record review and interview, the center did not ensure that they obtain the results of the fingerprint based background check prior to the first day of employment. Evidence: 1. Staff 1 has a hire date of 9/18/18. The results of the fingerprint based background check for staff 1 was not received until 10/3/18. 2. Staff 2 has a hire date of 8/20/18. The results of the fingerprint based background check for staff 2 was not received until 9/26/18. 3. Staff 3 has a hire date of 8/20/18. The results of the fingerprint based background check for staff 2 was not received until 9/26/18. 4. Staff 4 has a hire date of 8/29/18. The results of the fingerprint based background check for staff 2 was not received until 10/1/18. 5. Administrative staff confirmed that staff 1, 2, 3 and 4 began employment prior to the results of the fingerprint background checks being received. Plan of Correction: Going forward, all fingerprint based background checks will be obtained before new staff begin employment.
