22VAC40-185 STAFFING AND SUPERVISION.
A self reported incident involving two children who were forcibly handled by a staff was investigated on 11/1/2018. Observation of the center's video recording of 10/23/2018, staff interviews, review of staff and children records, written staff statements and parent interviews were conducted. During the investigation, violations were determined pertaining to care and protection, forbidden actions and failing to report suspected child abuse. Standard #: 22VAC40-185-80-B Description: Based on staff interviews, staff failed to immediately report a suspected child abuse incident in accordance with 63.2-1509 of the Code of Virginia. 1. On 10/23/2018, Staff #2 a mandated reporter, witnessed a suspected child abuse incident and failed to immediately report the incident to Child Protective Services. 2. On 10/23/2018, Staff #2 informed Staff #3 of the witnessed incident. Staff #3 failed to immediately report the incident to Child Protective Services. 3. The incident was not reported to Child Protective Services until the afternoon of 10/26/2018. Plan of Correction: A mandatory meeting was held for all staff on 10/29/2018 on forbidden actions and mandated reporter. Staff #2 and #3 were retrained on child abuse and mandated reporter on the social service site. School Principal was out of town at Nobel's yearly training. The incident was reported to CPS and licensing as soon as it was reported to management. A meeting was held on 10/29/2018. At this meeting teachers were retrained on forbidden actions and mandated reporter.
Standard #: 22VAC40-185-340-A Description: Based on review of the Center's video recording and staff interviews, staff failed to ensure the care, protection and guidance of a child.
1. On 10/23/2018, Staff #2 witnessed Staff #1 use a forbidden action with Child #2. Staff #2 stated they witnessed Staff #1 restricting Child #2's movement and witnessed Staff #1's hand over Child #2's mouth.
2. Staff #2 stated "I told [Staff #1] three times to let [Child #2] go." Staff #2 further stated that "[Child #2] looked scared."
Plan of Correction: Staff #1 was terminated immediately. Staff #1 no longer works for Chesterbrook Academy.
Standard #: 22VAC40-185-410-1 Description: Based on review of the Center's video recording of10/23/2018, staff written statements and staff interviews, staff used a forbidden action of roughly handling two children.
l. On 10/23/2018 during morning circle time, the Center's video recording system recorded Staff #1 forcibly grabbing Child #1's
(2 years old) left arm requiring the child to face forward. Staff #1 was also observed grabbing Child #1 by the top of their head requiring the child to face forward. Staff #1 was also observed grabbing the jaw of Child #1 and pulling the jaw, to require the child to face forward.
2. On 10/23/2018 during morning circle time, the Center's video recording system recorded Staff #1 restricting Child #2's (3 years old) movement by placing by placing the child on their lap then wrapping their legs over the child's legs to prevent the child from getting up or moving. Staff #1 provided a written statement which stated "I sat the child on my lap while raising my voice I lost my temper and proceeded to put my legs around [Child #2]" and "I'm sad to admit that I did cover [Child #2]'s mouth to have [Child #2] stop yelling/screaming".
Plan of Correction: Staff #1 was terminated immediately. A meeting was held on 10/29/2018. At this meeting teachers were retrained on forbidden actions and mandated reporter. Staff members are working closely with administration team on problematic behaviors.
