- Technical Assistance:
The licensing inspector conducted an unannounced complaint inspection in response to a complaint that was received by the licensing department on November 20, 2018 regarding allegations of forbidden actions. The inspection was completed on Tuesday, November 27, 2018. The inspector was on site from 2:50pm to 4:40pm. Interviews with staff were completed, observations were made in the center, and documentation was reviewed. Additional documentation was requested and received on Thursday, December 13, 2018. The preponderance of the evidence gathered during the investigation supports the allegation; therefore, the complaint is determined to be valid. See the violation notice for more details. If you have any questions about this inspection, please contact the licensing inspector at (804) 662-9760. **PROVIDER** Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice and return it to me within five business days from today. You will need to specify how the deficient practice will be or has been corrected. Just writing the word ?corrected? is not acceptable. Your plan of correction must contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measures. Please do not use staff names; list staff by positions only.
Standard #: 22VAC40-185-340-A Complaint related: Yes Description: Based on a review of video footage, photographs on 11/27/2018, and child interview with local child protective services worker on 11/19/2018, the center did not ensure the care, protection, and guidance of the children in care. EVIDENCE: 1. Video footage taken on 11/19/2018 shows Staff #1 yanking a blanket from Child #1. This caused Child #1 to hold her neck. 2. Photographs taken on 11/27/2018 show a long red mark about 5 inches on length and 1 inch in width on Child #1's neck 3. On 11/19/2018 Child #1, who is four years old, stated that she got the mark on her neck from her blanket while she was sleeping on her cot at nap in her classroom. Plan of Correction: 1)Visit classrooms and inform staff of proper supervising and protecting with ways to guide the children in care. Correction starting 12/21/2018, written document on proper supervision of children.
2) increase training on how the children are to be cared for on a daily basis. Correction started 12/21/2018, conducted staff meeting on proper care and protection of children in our care.
3) Director will visit each classroom more than 2 times a day that is currently conducted & provide ways of obtaining the proper training. Correction started 12/20/2018 by visiting each class 4 times a day.
Standard #: 22VAC40-185-410-1 Complaint related: Yes Description: Based on a review of video footage and staff interview on 11/27/2018, the center did not ensure that roughly handling a child was forbidden. EVIDENCE: 1. Video footage taken on 11/19/2018 shows Staff #1 yanking a blanket from around the neck of Child #1 with enough force that it caused Child #1 to shift from laying in a vertical position (head at the top of the cot, feet at the bottom of the cot) on her cot to a horizontal position(head off the left side of the cot, feet off the right side of the cot). 2. Video footage taken on 11/19/2018 shows Child #1 holding the left side of her neck with her left hand after Staff #1 removed the blanket from her. 3. Staff #1 stated that she had to pull "with a little force" to remove the blanket from Child #1 because Child #1 was holding onto the blanket. Plan of Correction: 1) Suspended employee on 11/20/2018 with write up. Correction starting 12/20/2018 the employee was terminated.
2) Monthly meeting of Forbidden Actions. Correction Started 12/21/2018, the first staff meeting along with memo and each employee's signature.
3) Director to conduct monthly meetings on Forbidden Actions (rough handling). Correction Started 12/21/2018, Director visited each classroom 4 times a day along with monitoring cameras while at front desk.
