22VAC40-665 STAFF QUALIFICATIONS & TRAINING

Comments:

The licensing inspector completed an unannounced complaint safety and health inspection regarding a serious injury in response to a complaint that was received by the licensing department on 01/16/2019. The licensing inspector was on site at the center on 01/25/19 from approximately 9:45 AM until 10:45 AM, on 01/30/19 from approximately 9:20 AM to 10:45 AM and 02/11/19 from approximately 12:00 PM to 12:25 PM. During the inspection, interviews with staff were completed, documentation was reviewed and classroom observations were conducted. The preponderance of the evidence gathered during the investigation supports the allegation and therefore the complaint regarding a child?s injury is determined valid. See the violation notice for additional details. Please complete the 'plan of correction' and 'date to be corrected' for each violation cited on the violation notice and return it to me within 5 business days from date of receipt. You will need to specify how the deficient practice will be or has been corrected. Just writing the word 'corrected' is not acceptable. Your plan of correction should contain: 1) steps to correct the noncompliance with the standards, 2) measures to prevent the noncompliance from occurring again, and 3) person(s) responsible for implementing each step and/or monitoring any preventative measure(s). Standard #:	22VAC40-665-550-2
Description:	Based on interviews, documentation review and observations, the center did not notify the department within two business days of a serious injury to a child while under the center's supervision. Evidence: During the 01/25/19, 01/30/19 and 02/11/19 interviews and documentation review, the licensing inspector determined the following: 1. On 01/14/19, staff stated Child A took a can of air freshener and sprayed Child B in the face. 2. Staff stated 0n 01/16/19 the parent of Child B was notified of the incident. The parent of Child B stated Child B was taken to the doctor on 01/17/19. The parent of Child B stated the staff at the center were notified on 01/17/19 that Child B was seen by a doctor. 3. During the 01/25/19 inspection, members of management confirmed they did not notify the department within two business days that Child B was seen by the doctor as a result of the 01/14/19 incident.
Plan of Correction:	The Center Director and Assistant Director need to notify the Department of Social Services within two business days of any doctor visits that are related to any incidents or accidents that happen in the center. In order to ensure that this will happen, our management team has been made aware of these expectations and sent out a friendly memo to parents that anytime their child receives medical treatment as a result of a center related incident that they are required to notify center staff. After management has been notified of a doctor visit, we will file the report online with the Department of Social Service within the appropriately required timeframe.
