Comments:
The licensing inspector completed an unannounced inspection in response to a self-reported concern regarding the supervision of children that occurred at the center on 01/09/2019. The Department was notified of the incident on 01/14/2019. On 01/22/2019, the licensing inspector was on site from approximately 10:45 AM until 12:25 PM interviewing staff, conducting observations at the center and reviewing documentation. On 02/08/2019, the licensing inspector was on site from approximately 2:57 PM until 4:55 PM reviewing documentation and conducting observations. The preponderance of the evidence gathered during the investigation supports areas of noncompliance with the licensing standards related to the supervision of children. Please complete the 'plan of correction' and 'date to be corrected' for each violation cited on the violation notice and return it to me within 5 business days from the date of receipt. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standards, 2) measures to prevent the noncompliance from occurring again, and 3) person(s) responsible for implementing each step and/or monitoring any preventative measure(s). Violations:
Standard #: 22VAC40-185-340-A
Description: Based on a review of documentation and interview on 01/22/2019, the center did not ensure that when staff are supervising children, they shall always ensure their care and protection. Evidence: 1) In a written statement dated 01/11/2019, Staff #1 stated "...another teacher told the children it was time to line up to go inside. [Child #1] started screaming and crying because he didn't want to go in at that time he was sitting on one of the little bicycles and it toppled over because he was throwing a temper tantrum. When the bike fell he hit his left side and proceeded to get up to get in line." 2) During interview on 01/22/2019, Staff #1 stated she observed when a bicycle fell on Child #1 (2-year-old) while he was throwing a "temper tantrum," but did not assist him or check for injuries. Child #1 sustained a bruise on his arm and on his hip as a result from this incident.

Plan of Correction: Per the Center: On 01/11/2019 staff were re-trained on injury prevention. Additionally, all staff will be re-trained on injury prevention, first aid, and incident reporting at the center's next staff meeting on 3/11/19.
