Comments:

An unannounced monitoring inspection was conducted on 02/04/2019 in response to a self-reported incident regarding a child's injury that occurred on 01/30/2019. Based on staff interviews, review of written policies and records violations were found in the areas of staff training and behavior guidance. Based on observations during the inspection on 02/04/2019 additional violations were found in the areas of daily activities and preventing the spread of disease. Violations were observed in five parts of the child day center standards and were reviewed with administrative staff at the exit interview.

Standard #:	22VAC40-185-180-B
Description:	Based on record review and interview, the center failed to ensure that staff shall be capable of carrying out assigned responsibilities. Evidence: 1. Child 1 , age three years, was injured on 01/30/2019 at approximately 4:55pm , when staff 1 placed her hand around his wrist and pulled him up from the floor. a. This resulted in nursemaid's elbow of the upper left extremity. b. Staff 1 explained that child 1 and child 2 were on the floor fighting over a toy while she was putting up Valentine decorations. 2. Staff 1, who has a hire date of 01/18/2019 as a program leader, did not have documentation of the 24-hour program leader training when she was placed with this group of children on the afternoon of 01/30/2019. a. Enrollment records indicate that staff 1 was alone with a group of six children ages three and four years on 01/30/2019. 3. Staff 1 stated to the inspector that she did not feel adequately trained or prepared to be left alone with this group of children. a. Staff 1 stated, " I didn't get any training." The only training I received was "cleaning up of the room." "There was no conversation about my training other than the director handing me the training packet with instructions for it to be completed by 02/18/2019. Staff 1 also confirmed that she had not received any training in the areas of behavior guidance, classroom organization or children's activities. b. Staff 1 indicated that she had not had the opportunity to learn the names of the children when she was placed in this classroom. c. Staff 1 additionally stated that administrative staff did not offer her any help. "They just threw me in there and expected me to go with the flow." d. Staff 1 had listed "how to handle children" as a weak point on the written interview documentation.
Plan of Correction:	The management team has put a new training policy into place and all staff are being retrained.
Standard #:	22VAC40-185-360-A
Description:	Based on observation, the center failed to ensure that the variety of daily activities for all age groups shall be age and stage appropriate and provide opportunities for teacher-directed, self-directed, and self-chosen tasks and activities; a balance of active and quiet activities; individual and group activities; and curiosity and exploration. Evidence: 1. Staff 1 did not provide a variety of age appropriate and teacher - directed activities for children in the preschool class on the afternoon of 01/30/2018 as demonstrated by the following: a. Staff 1 stated that she only provided one activity to the group of 7 preschool children on the late afternoon of 01/30/2018 because she was trying to keep the room clean. b. I opened up two stations, cars and dress up, after snack....so they don't get toys everywhere." c. Staff 1 stated that she had the children clean up the cars later that afternoon and she then allowed only one activity, "mainly dress up" to remain available to the group of 7 preschool children. d. At approximately 4:45pm staff 1 stated that child 1 and child 2 began fighting over a pocket book while she was putting up classroom decorations. 2.. A variety of age appropriate activities was not provided by the staff in the two-year old class during the inspection on 02/04/2019 which lasted from 9:40am - 11:40am. a. Children were observed through out this time wandering around the room with no planned activity to occupy their time. b. Multiple children were heard and observed crying off and on while they aimlessly walked around the room holding blankets. c. A child used a chair to climb up onto the diapering table without knowledge of the staff in the classroom. d. A child was observed placing a fabric storage container over his head and pulling it down his body where the container became stuck on his legs. e. The staff in the classroom was heard through out the morning telling the children to "Get down" "Stop" and "Don't do that."
Plan of Correction:	-All teachers are retrained on daily activities for all age groups and on keeping children busy with many different activities for group or individual. - Staff are retrained on safety in the classroom - The staff were also spoken to about how to speak to the children.
Standard #:	22VAC40-185-410-1
Description:	Based on interview and a review of written reports and policies, the center failed to ensure that roughly handling of a child is forbidden. Evidence: Child 1, age three years, received an injury to his left arm that required medical attention after staff 1 pulled him up from the floor by his wrist: 1. Staff 1 stated that while she was putting up Valentine decorations, on the afternoon of 01/30/2019, she heard child 1 and child 2 fighting over a toy. a. Staff 1 stated, " My back was turned and I heard child 1 hit the other student kind of hard." "They were really going at it." b. Staff 1 explained, "Child 1 was on top of child 2 ....and I broke up the fight." c. Staff 1 stated that she pulled child 1 off of child 2 by pulling child 1 up from the floor by his wrist. 2. Child 1 was crying and continued to cry after being placed in time out according to staff 1. a. Staff 1 stated that child 1 told her that his arm hurt and that it hurt from her pulling him by the wrist. 3. Staff 2 stated that when she observed child 1 he would cry when she attempted to check his elbow area. a. Staff 2 further stated, "I could tell in his cry that it was not a normal cry ...that it was hurting." 4. Child 1 stated that staff 1 had "pulled my wrist" and that it hurt. 5. Child 1 was taken to the emergency room by his parent and received medical attention for nursemaid's elbow of the upper left extremity.
Plan of Correction:	Staff policies are in the process of being updated which will include forbidden acts.
Standard #:	22VAC40-185-490-B
Description:	Based on observation, the center failed to exclude a child with recurrent vomiting in the designated quiet area until leaving the center. Evidence: 1. Child 3 , age three years, was not excluded or placed in a designated quite area after vomiting multiple times in the preschool classroom at approximately 10:30am. a. The child was observed sitting with a group of children on the carpet area of the classroom and then at the table during lunch while he waited for his parent to pick him up. b. Child 2 was picked up by his parent at 11:20am.
Plan of Correction:	Sick children will be placed in a quite area, away from other children, in the future.
