63.2(17) License & Registration Procedures

An unannounced monitoring inspection was completed on 3/19/19. There were 12 children present. Five children's records and five staff records were reviewed. No medications were at the center. The inspector arrived at the center at 3:10 pm and departed at 6:00 pm. The children were observed at arrival, during supper time, during homework time, and during gym time.

Standard #: 22VAC40-185-60-A
Description: Based on record review, the center failed to ensure that all children's records contained documentation of all required information. Evidence: 1. The record of child #2 had the biological father listed as not authorized to pick up the child. The child's birth certificate was in the record so as to verify the name of the person not authorized to pick up the child as the biological father. There was no appropriate legal paperwork on file when the custodial parent requests the center not to release the child to the other parent.

Plan of Correction: The administrative personnel called the parent during the inspection. The parent will provide the legal paperwork to support the documentation of the other parent not picking up the child.

Description: Based on record review, the center failed to ensure that all staff had a completed DSS search of the central registry within 30 days of employment or volunteer service. Evidence: 1. Staff #1 had a documented hire date of 9//26/18. There was no completed DSS search of the central registry for staff #1. The director had documented that the search was sent on 3/6/19.

Plan of Correction: The director will make sure staff have a completed DSS search of the central registry within 30 days.

Standard #: 63.2(17)-1720.1-B-2
Description: Based on record review, the center failed to ensure that all staff had a fingerprint background check as a part of the background check process prior to hire. Evidence: 1. There was no fingerprint completed for staff #3. Staff #3 was present during the inspection and observed working with the children. Staff #3 had a documented hire date of 10/21/18. 2. The fingerprints for staff #1, #2, #4, and #5 were completed after the documented hire dates of the staff. The documented hire dates and dates of fingerprints were: staff #1 - 9/26/18; 9/28/18; staff #2 - 9/23/18; 9/26/18; staff #4 4/18/18; 4/30/18; staff #5 - 11/26/18; 12/5/18.

Plan of Correction: Staff #3 will make an appointment to have the fingerprint completed this week. The director stated that the staff are not hired for compensated employment and are volunteers until all information is completed to be released as a staff person. The director will document the release date in addition to the "hire" date for volunteer services.

Standard #: 63.2(17)-1720.1-B-3
Description: Based on record review and interview, the center failed to ensure that the results of a search of the central registry maintained pursuant to ? 63.2-1515 and any child abuse and neglect registry or equivalent registry maintained by any other state in which the individual has resided in the preceding five years for any founded complaint of child abuse or neglect against him or her was obtained for staff who had resided in another state. Evidence: 1. Staff #5 had disclosed on the Sworn Statement or Affirmation dated 12/5/18 that they had lived in another state other than Virginia within the past five years. There was no search of the central registry observed in the staff person's record for that state. The program director verified that a central registry check had not been requested from the state where the staff had resided.

Plan of Correction: The director will send the out-of-state search of the central registry tomorrow.
