Comments:
An unannounced non-mandated monitoring inspection was completed on 05/07/2019 from 9:40 A.M.-12:15 P.M. The inspection was conducted in a response to a self reported incident that occurred at the center on 05/02/2019 . One staff record, and one child's record were reviewed. Five staff members were interviewed, and documentation of a text message was reviewed. The exceptions to compliance are noted on the violation notice. Violations:
Standard #: 22VAC40-185-40-E
Description: Based on review of policies and procedures, the operational responsibilities of the licensee did not ensure that the center's activities and services are maintained in compliance with the center's own policies and procedures that are required by these standards. Evidence: 1. The center did not follow their policy for Behavior Guidance located in the Parent Handbook. The handbook states," behavior concerns will be dealt with promptly and with love and respect. A child will never be physically, verbally, or emotionally harmed when discipline is required." 2. Staff #1 stated that on 05/02/2019 she had a group of three year old children at the bathroom, located in the hallway, after naptime. Staff #1 stated that Child #1 was not listening. Child #1 would not sit down, was being defiant, and taking her shoes off. Staff #1 stated she had Child #1 come stand beside her and held her arm around the wrist. Staff #1 stated that Child #1 kept trying to pull away from her. Staff # 1 stated she told the child "don't pull away from me", and that she continued to hold the child by the wrist. 3. At snack time Staff #1 noticed a red mark on her "arm at the top and around her wrist" of Child #1. 4. Staff #1 sent a text message to the parent of Child #1 on 5/2/2019 at 5:51 and stated, "I noticed I think her left arm at the top and around her wrist looked a little red I don't know why. Her wrist could of been when I was holding her hand today having her stay by my side to be good and she likes to pull away."

Plan of Correction: The director will review will all staff the center's policy on behavioral guidance and what is accepted and what is unacceptable. All staff will sign a form that they have received the training to be placed in their staff file.

Description: Based on interviews and staff documentation, the center failed to use behavioral guidance that was constructive in nature, age and stage appropriate, and intended to redirect children to appropriate behavior and resolve conflicts. Evidence: 1. Staff #1 stated that on 05/02/2019 she had a group of three year old children at the bathroom, located in the hallway, after naptime. Staff #1 stated that Child #1 was not listening. Child #1 would not sit down, was being defiant, and taking her shoes off. Staff #1 stated she had Child #1 come stand beside her and held her arm around the wrist. Staff #1 stated that Child #1 kept trying to pull away from her. Staff # 1 stated she told the child "don't pull away from me", and that she continued to hold the child by the wrist. 2. Evidence: 1.Staff #1 stated that on 05/02/2019 she had a group of three year old children at the bathroom, located in the hallway, after naptime. Staff #1 stated that Child #1 was not listening. Child #1 would not sit down, was being defiant, and taking her shoes off. Staff #1 stated she had Child #1 come stand beside her and held her arm around the wrist. Staff #1 stated that Child #1 kept trying to pull away from her. Staff # 1 stated she told the child "don't pull away from me", and that she continued to hold the child by the wrist. 2. Plan of Correction: The staff member is no longer employed by the center. The director will review unacceptable and acceptable forms of behavior guidance will all staff.
