Comments:
An incident was self-reported to Licensing on 4/17/19 concerning staff rough handling a child. An unannounced inspection was initiated on 4/18/19 and a follow up inspection was conducted on 4/23/19. Observation of the Center's video recording on the morning of 4/12/19 was made, staff interviews were conducted, a review of staff and child records and staff written statements was completed. Based on the preponderance of evidence, violations were found pertaining to behavioral guidance and programming. Please email me at: lisa.hudson@dss.virginia.gov with any questions.

Violations:
Standard #: 22VAC40-185-380-A
Description: Based on observation of the center's video recording and staff statements, the daily schedule on 4/12/19 did not allow flexibility as children's needs require. Evidence: l. According to the video on 4/12/19, the Pre K class (age 4 and 5 yrs) was working on a table top activity for approximately 90 minutes. The children were observed no longer engaged in the activity, and began throwing some of the seeds the children were working with. The children were observed getting up from the tables and walking around the classroom. 2. According to Staff #4, the children had lost attention in the activity and a transition to another activity such as going outside was not provided. 3. Staff #5 stated "At that time, I didn't think. I just wanted to finish the activity." Staff #5 further stated that "It was not appropriate to have them finish."

Plan of Correction: Staff were re-trained on proper and appropriate classroom schedule and routine, which allows for modifications and/or flexibility based on the needs of the students.

Standard #: 22VAC40-185-400-B
Description: Based on parent and staff interviews and observation of the center's video recording, behavioral guidance was not constructive in nature, age and stage appropriate, and intended to redirect children to appropriate behaviors. Evidence: 1. The video recording on 4/12/19, shows Staff #5 removing Child #2's (4yrs) arm away from the table activity to prevent the child from touching the seed activity project. Staff #5 was observed moving Child #2 away from the seed project by holding their upper right arm to lead the child from their chair. Staff #5 then lead Child #2 by the arm and sat them down at a different table. Child #2 sat at the table for approximately 14 minutes. During this time the child was not engaged in any activity. Staff #5 was observed interacting with other children, and did not return to Child #2 to provide any behavioral guidance or redirection. 2. On 4/12/19 between 12:15pm and 1pm, Staff #5 was observed directing Child #3(5yrs) to stand against the wall located by the perimeter door on two separate occasions. Child #3 was observed standing at the wall for approximately 14 minutes the first time and 17 minutes the second time while the remainder of the class was preparing and sitting for lunch. Staff #5 stated "I don't remember how long, it was too many things happening." and "Usually we have a group of kids that listen but that day they weren't listening." 3. Staff #5 did not verbally instruct children(ages 4 and 5yrs) in the Pre K class to sit down for lunch. Staff #5 was observed having the children who were not already sitting down for lunch, sit down by leading them by their arms to chairs and did not allow children to choose where they wanted to sit. Staff #5 stated, "They don't listen I tried to make them sit down."

Plan of Correction: Staff were retrained on proper behavioral guidance during classroom activities. Staff were re-trained on forbidden actions and proper and appropriate behavioral guidance policies and procedures were reviewed.
