An unannounced Complaint Inspection was initiated in the center on May 23, 2019 and completed on June 11, 2019 in regards to a complaint received by the department regarding the area of Programs. An inspection was conducted at the facility, interviews with staff and observations were made. The inspection was conducted jointly with a local agency representative. There was a preponderance of evidence to support the allegation for programs (behavior guidance), therefore it was determined to be Valid. The area of non-compliance was noted on the violation notice. The results of this inspection were reviewed with the Center Director. Standard #: 22VAC40-185-410-1 Complaint related: Yes Description: Based on interviews, documentation review and observations, the license did not ensure physical punishment, striking a child, roughly handling or shaking a child, restricting movement through binding or tying, forcing a child to assume an uncomfortable position, or exercise as punishment ocurss. Evidence: On May 14, 2019 between 3:30 pm and 4:00 pm in the toddler room, staff #1 paced their hands on the arm of child #1 to remove them from the outside classroom door. Interviews with parties involved and observations of pictures taken, confirmed that staff #1, placed their hands on child #1 in such a manner that it has been determined to be rough handling, as it left a red mark between 1 and 2 inches long between the child's forearm and upper arm. Plan of Correction: Staff #1 was immediately sent home on the day of the incident and was terminated (5-15-19) and the Center Director will review standard guidelines with staff.
