Comments:
The licensing inspector conducted an unannounced inspection in response to a self-reported concern regarding supervision that occurred at the center on May 1, 2019. The Department was notified of the incident on May 2, 2019. The investigation was initiated on May 8, 2019 and completed on June 14, 2019. On May 8, 2019, the licensing inspector was on site from 1:45pm to approximately 5:15pm. Interviews were completed, observations were made in the center, and documentation was reviewed. The preponderance of the evidence gathered during the investigation validates the self-reported incident. See the violation notice for more details. Please complete the 'plan of correction' and 'date to be corrected' for each violation cited on the Violation Notice and return it to me within 5 business days from the date of receipt. Please specify how the deficient practice will be or has been corrected. Violations:
Standard #: 22VAC40-185-40-E
Description: Based on a review of policies and procedures, interviews and a review of documentation on 05/08/2019, the center did not ensure that the center's activities and services were in compliance with the center's own policies and procedures related to supervision that are required by the standards. Evidence: 1) On 05/01/2019 at approximately 4:45pm, 3-year-old, Child #1, and 3-year-old, Child #2, were found alone and unsupervised on the playground. 2) During interview, Staff #3 reported that the School Age class went out to the playground at approximately 4:45pm after the Preschool class went back to their classroom. When the School Age class arrived to the playground, two of Staff #3's students told him that there were "two babies in the sandbox." Staff #3 notified a member of management, Staff #4, and turned the children over to her. 2) During interview, Staff #2 reported that the children in the Preschool class went inside at approximately 4:40pm. During the transition, she reported she counted 17 children in the classroom, but the Child Supervision Record (CSR) had a total of 25 children on the form. Staff #2 reported some of the children had been picked up during that time, so the total number of children was not accurately recorded on the form. Staff #2 stated the number of children in the classroom seemed wrong, but she could not "figure out who it was." 3) In a written statement, Staff #5 wrote "[Staff #4] was informed by a School Age teacher that two students were left unattended by the Preschool classroom. [Staff #4] immediately went to the Preschool/School Age playground to assess the situation and two students from Preschool were left outside. [Staff #4] turned one student over to the grandfather who was being picked up at the time. [Staff #4] escorted the other student to Preschool and asked the two teachers in that classroom if they were missing anybody. [Staff #1] responded that something seemed a little off as far as the numbers were concerned and she was about to take a few of her children outside to reassess the playground. [Staff #4] informed [Staff #1] and her co-teacher that two students were left outside and that this was a major KinderCare and licensing violation. [Staff #4] suggested new ways to help the teachers keep track of their students during transitions and document them on the CSR." 4) The center's supervision of children policy requires that "all individuals and/or groups of children must be supervised at all times while in our care; that "children must not be left alone or unsupervised in classrooms, hallways, offices, lobbies, bathrooms, playgrounds, or vehicles;" and that "name-to-face attendance (visually confirming children are present by matching the names on the CSR to the faces in the classroom) must be taken at least every 30 minutes and during any large class transitions (i.e. going outside to the playground, loading children onto a van for a field trip, moving an entire class into an enrichment room to watch a puppet show, etc.)."

Plan of Correction: Per the Center: -All staff was retrained on Child Supervision Records and KCE policies on supervision and transitions. 5/21/2019 -Management has acknowledgement forms signed and placed in staff files for licensing and District leader to view during visits. 5/2/19 -Management will complete 2 signatures daily on the back of CSRs along with times completed to ensure that accuracy of attendance is being recorded. 5/3/2019 -For 2 weeks managements observed every transition that occurred in the classroom. Began 5/3/19 -Management will complete observation of large group transitions and coach staff on any corrections needed. 5/3/2019 -Regional Program quality advisor will visit within 90 days to ensure that all pieces are being completed. -Administrative actions will be taken if any staff continue to not follow our supervision standards District Leader and Corporate Team Commitments: -District leader will do unannounced visits to the center to ensure that staff are being retrained and that observations are completed -Disctric Leader will make sure any new management is trained CSR and supervision practices -Program Quality Business Partner will complete a 90 day follow up with teachers and management to ensure comprehension of supervision and CSR completion

Description: Based on interview and documentation reviewed on 05/08/2019, the center did not ensure that children under 10 years of age always shall be within actual sight and sound supervision of staff. Evidence: 1) During interview, Staff #3 reported that on 05/01/2019, Child #1 (3-year-old) and Child #2 (3-year-old) were found unsupervised on the playground at approximately 4:45pm when the School Age class went outside. 2) During interview, Staff #1 and Staff #2 reported that on 05/01/2019, the Preschool class transitioned inside from the playground at approximately 4:40pm. Staff #1 and Staff #2 reported that approximately ten minutes after the Preschool class had been inside, Staff #4 reported to Staff #1 and Staff #2 that Child #1 and Child #2 were left unsupervised on the playground. Staff #1 and Staff #2 reported they were not aware that Child #1 and Child #2 were out of sight and sound supervision until they were notified by Staff #4. It is estimated that Child #1 and Child #2 were out of sight and sound supervision for approximately five minutes. Children under 10 years of age always shall be within actual sight and sound supervision of staff.

Plan of Correction: Per the Center: -Teachers and Center management reviewed the licensing standards regarding supervision within sight and sound on 5/2/2019 -Additional resources have been given to staff to help with "active playground supervision," transitions, and interactive CSR activities. 5/2/2019 -Management will continue to have conversations with staff around the importance of compliance and supervision safety. -All new staff coming in will observe supervision and transition activities in classrooms prior to being in ratio District Leader and Corporate Team Commitments: -District leader will do unannounced visits to the center to ensure that staff are being retrained and that observations are completed -Disctric Leader will make sure any new management is trained CSR and supervision practices -Program Quality Business Partner will complete a 90 day follow up with teachers and management to ensure comprehension of supervision and CSR completion
