Comments:
The licensing inspector conducted an unannounced inspection in response to a self-reported concern regarding the physical plant that occurred at the center on April 17, 2019. The Department was notified of the incident on April 17, 2019. The investigation was initiated on May 14, 2019 and completed on June 20, 2019. On May 14, 2019, the licensing inspector was on site from 10:30am to approximately 3:30pm. Interviews were conducted, observations were made in the center, the playground was inspected, and documentation was reviewed. The preponderance of the evidence gathered during the investigation validates the self-reported incident. See the violation notice for more details.

Violations:
Standard #: 22VAC40-185-270-A
Description: Based on observation and interviews on 05/14/2019, the center did not ensure that areas and equipment of the center, inside and outside, shall be maintained in a clean, safe and operable condition. Unsafe conditions shall include, but not be limited to, splintered, cracked or otherwise deteriorating wood; chipped or peeling paint; visible cracks, bending or warping, rusting or breakage of any equipment; head entrapment hazards; and protruding nails, bolts or other components that could entangle clothing or snag skin.

Evidence: 1) During interview, Staff #1 reported that Child #1 (2-year-old) was out on the playground on 04/17/2019 when she stuck her finger inside a piece of equipment that had a missing bolt. Staff #1 reported that another child spun the toy drum that was loosely attached to the playground equipment while Child #1's finger was inside the hole and it severed the tip of Child #1's right index finger.

2) Staff interviewed reported the piece of equipment on the playground was missing a bolt, which resulted in injury to Child #1, but staff had no knowledge of the missing bolt until after the incident occurred.

3) Staff interviewed reported and documentation reviewed showed that Child #1 received injuries to her right index finger that required surgery to repair.

Plan of Correction: Per the director: The piece of equipment that was loose was removed from the from the playground equipment on the day of the incident. The center is working on a permanent solution to ensure the remaining part of the piece of equipment is securely covered. A member of management conducts daily checks on the areas of the center, inside and outside, to ensure there are no safety concerns.
