Comments:

An unannounced non-mandated inspection was completed on June 7, 2019 from 9:00 A.M.-10:30 A.M. The inspection was conducted to a response of a self-reported incident that occurred at the center on 05/22/2019. Two children records, three staff records, attendance sheet, staff documentation, and polocies and procedures were reviewed. Three staff members were interviewed, and three staff members walked the licensing inspector thru the events that occurred and where staff were positioned in the classroom. There were no children present at the center as it was a teacher work day. The exceptions to compliance are noted on the violation notice. Standard #:	22VAC40-185-340-A
Description:	Based on review of documentation and interviews, the center failed to ensure care and protection for children at all times. Evidence: 1. On 5/22/2019 at approximately 10:00 A.M. in Classroom A, Child #1 (age 3) was using the single occupancy restroom when Child #2 (age 4) entered the restroom and touched Child #1 inappropriately. 2. Staff #1 reported that she saw Child #2 enter the restroom and was aware the restroom was already occupied by Child #1. 3. Staff #1 stopped to answer a child's question before proceeding to the restroom. 4. Child #1 told Staff #1 that Child #2 had inappropriately touched Child #1 while in the restroom. 5. Staff #1 reported Child #2 confirmed touching Child #1 in the restroom and Child #2 told her that "(Child #2) would never do it again."
Plan of Correction:	Reviewed and changed the bathroom policy. A bathroom pass is now held by a teacher. Door was open it is now closed unless in use and a teacher is stationed in the back of the classroom to monitor hall to the restroom.
Standard #:	22VAC40-185-340-F
Description:	Based on documentation and interview, the staff failed to ensure that children under 10 years of age shall be within actual sight and sound supervision of staff. Evidence: 1. On 5/22/2019, in Classroom A, there were 23 children present, ages three through six years, with three staff present. 2. Child #1 and Child #2 were alone in the single-occupancy bathroom located in the classroom out of sight supervision of staff. 3. Staff #1 reported that she saw Child #2 enter the restroom and was aware the restroom was already occupied by Child #1. 4. Child #2 inappropriately touched Child #1 while they were alone in the restroom.
Plan of Correction:	The restroom door was previously opened at all times. Now remains closed unless in use. Removed child access to extra clothes from the hallway. Staff are stationed in the back of the classroom outside of hallway when the restroom is in use.
