An unannounced Complaint Inspection was initiated in the center on September 17, 2019 and completed on October 7, 2019 in regards to a complaint received by the department regarding the area of Programs. An inspection was conducted at the facility, interviews with staff/ parties involved, center documentation and video footage were also reviewed. There was a preponderance of evidence to support the allegation for behavior guidance and forbidden action therefore the complaint was determined VALID. The areas of noncompliance were noted on the violation notice. The results of this inspection were reviewed with the Center Director during the exit interview. Standard #: 22VAC40-185-400-B Complaint related: Yes Description: Based on staff interviews, video observation and review of center documentation it was determined a center staff did not ensure that behavioral guidance shall be constructive in nature, age and stage appropriate, and shall be intended to redirect children to appropriate behavior and resolve conflicts.
Evidence: Video footage was reviewed and showed that on September 10, 2019, between 3:30 pm and 5:00 pm, Staff #1 was observed hitting Child #1, 3 years old, and redirecting the child by placing two hands on his arm and roughly putting him in a chair. Staff #1 did not offer behavior guidance in manner that is constructive in nature and offers redirection.Plan of Correction: All staff members have been retrained and resigned policy on discipline policy.
Standard #: 22VAC40-185-410-1 Complaint related: Yes Description: Based on staff interviews, video observation and review of center documentation it was determined a center staff engaged in forbidden action.
Evidence: On September 10, 2019, in the three year old classroom, between 3:30 pm and 5:00 pm, Staff #1 was observed roughly handling Child #1, age 3.
1) Staff #1 was observed on video footage hitting Child #1 on the arm after the child had taken something off of the teachers desk. Center documentation and staff interviews verbally confirmed child #1 took cookies off of the teachers desk
2) Staff #1 was observed on video footage, grabbing the right arm of Child #1 and lifting the child out of an adult chair, near the teachers desk, using only the child's right arm. The child's feet were dangling as they did not touch the floor, as he was lifted from the chair by his arm.
3) Staff #1 was observed on video footage, roughly handling child #1 and using both hands to place child #1 in a children's chair. Center staff verbally confirm, child #1 was observed crying.
4) Center documentation and center staff verbally confirmed, staff#1 was terminated on 9/11/2019 for "hitting a child on the arm and physically removing him from the chair" and later in the day "placing a child in a chair with more force than what was necessary" on 9/10/19 between 3:30 pm and 5:00 pm.Plan of Correction: All staff members have been retrained and resigned policy on discipline policy.
