The inspector conducted an unannounced complaint inspection in response to a complaint received in the licensing office on 07/31/2019 concerning care of children. Staff records and children's records were reviewed and interviews were held. One part of the complaint is determined to be substantiated due to the preponderance of evidence gathered during the investigation. A second part of the complaint is determined not substantiated due to a lack of preponderance of evidence. Please complete the plan of correction and date to be corrected for the violation and return to the licensing office within 5 business days of receipt. Standard #: 22VAC40-185-410-1 Complaint related: Yes Description: Based on interviews, a forbidden action occurred at the center against a child.
Evidence:
1. The inspector interviewed staff #1 about an incident in which child #1 stated he was grabbed by the neck and a mark was left. Staff #1 stated, "I got frustrated because he wouldn't do what I was asking and I grabbed him by his neck." Staff #1 demonstrated how she grabbed child #1 by the neck and it was in the front of the neck. 2. On 07/31/2019 child #1 was interviewed and verified that staff #1 did grab his neck and left a mark from fingernails.Plan of Correction: Director spoke with all staff about behavior management. The director identified a training on the Penn State website concerning working with challenging behaviors that all staff will complete.
