Comments:
The licensing inspector conducted an complaint inspection in regards to staffing and supervision and special care provision and emergencies. Interviews were conducted , documentation was reviewed and video footage was reviewed. Based on a interviews and observation during investigation, a preponderance of evidence does support the allegation, therefore the complaint is determined VALID.

Description: Based on interview with staff and observation of video documentation it was determined that staff did not always ensure children's care, protection, and guidance.

Evidence:

On 8/13/2019 at 10:22am in the preschool classroom children were lining up to transition to the outdoors. Staff #2 stated child #1 was upset because she wanted to be a line leader. Staff #1 is observed on video footage holding Child #1?s left wrist while child was pulling away , stomping her feet, arching her back and dropping to the ground. Staff #1 continue to move the Child #1 by pulling arm upward and around to the other side of her body causing the child's feet to slide and drag. Staff #1 releases Child #1?s wrist. Child #1 is laying on the carpet floor while Staff #1 assisting other children and staff. Staff #1 extends her hand out to Child #1 to stand up. Child #1 continues to lay on the floor. Staff #1 then pulls child upward by her right wrist while Child #1 twist to the left side into a kneeling position. Staff #1 went to assist another staff with a child. Staff #1 came back to Child #1 who is in kneeling position and lifted the child upward by child #1?s left wrist to a standing position. Child #1 is then seen holding her right arm. Staff #2 stated Child #1 was crying and told her that her arm hurts. Staff #2 gave her ice pack. After staff noticed that child was continuing to complain about her arm and they were unable to determine the injury. Center called parent and Child #1 was picked up and brought child to Emergency room. Child #1 was later diagnosed with a dislocated elbow which is also known as ?nurses maid elbow.?

Plan of Correction: The staff have been trained on properly handling behavior challenges. Have trained on safe practice of picking up children. An the center had educated the staff about nurse maid elbow.
