Technical Assistance:
Technical assistance was provided in the following areas of the standards: 22VAC40-191 (Background checks); 22VAC40-185-(5)-340 Supervision)-185-(8)-570 (infant feeding)

Comments:
An unannounced monitoring inspection was conducted on 12/4/19 from 9:50am - 11:20am. During the inspection there were 102 children ages four months old through five years old in care with 26 staff. Children were observed participating in various activities in the classroom, and playing outside. Records were reviewed for ten children and 15 staff during the inspection. Medication, emergency procedures and emergency supplies were reviewed during the inspection. Areas of non-compliance are identified on the violation notice and were discussed during the exit interview.

Violations:
Standard #: 63.2(17)-1720.1-B-3
Description: Based on a review of 15 staff records, it was determined that the facility did not deny continued employment of a staff who did not have a search of the central registry finding within 45 days of employment from any other state in which the employee has resided in the preceding five years.

Evidence:
1. The record for staff #1 (date of hire 8/16/19) did not contain documentation of a completed search of the central registry finding from Texas. The sworn statement indicated staff #1 had previously lived in Texas within the last 5 years.
2. Staff #12 (Program Director) review the record for the staff #5 and confirmed that the search of the central registry finding from the state (Texas) in which staff #1 previously resided in has not been received.

Plan of Correction: The facility responded: The search of the central registry for Texas for staff #1 was sent previously. We will inquire as to whether it has been completed. If they do not have it, we will have staff #1 complete a new one. All new staff who have lived in a state other than Virginia within the last 5 years will complete a search of the central registry for that state and we will follow up to make sure the results are received within 45 days.
