Technical Assistance:
Technical assistance was provided in the following areas of the standards: 22VAC40-191 (Background checks); 22VAC40-185-(2)-60-A (Children's records); 22VAC40-185-(2)-70-A (Staff records); 22VAC40-185-(7)-510 (Medication); 22VAC40-185-(7)-540 (Emergency supplies);

Comments:
An unannounced monitoring inspection was conducted on 1/14/20 from 4:45pm -6:00pm. During the inspection there was 13 children five years old to ten years old in care with three staff. Children were observed participating in various activities in the classrooms, eating snack and lunch, playing on the indoor athletic fields, and during rest period. Records were reviewed for five children and four staff. Medication, emergency procedures and emergency supplies were reviewed during the inspection. Areas of non-compliance are identified on the violation notice and were discussed during the exit interview.

Violations:
Standard #: 22VAC40-185-140-A
Description: Based on a review of five children's records, it was determined that the facility did not ensure that each child in attendance had a completed physical within one month of attendance.

Evidence:
1. The record for child #5 (date of enrollment 9/3/19) did not contain a physical examination.
2. Staff #1 (Program Director) confirmed that the record for child #5 did not contain a physical examination, and that child #5 had been enrolled for more than 30 days.

Plan of Correction: The facility responded: The parents of child #5 will be asked to provide a copy of a physical examination. All newly enrolled children will have documentation of a physical examination in their record within one month of attendance.

Standard #: 22VAC40-185-510-C
Description: Based on a review of the medication being stored at the facility, it was determined that the facility did not ensure that they did not follow their procedures to prevent the use of outdated medication.

Evidence:
1. The medication (Epi-Pen injector) for child #2 had an expiration date of October 2019.
2. Staff #1 (Program Director) confirmed the medication for child #2 was expired.

Plan of Correction: The facility responded: The medication will be given back to the parents of child #6. All medication will be returned to the parents prior to the expiration date.
