Technical Assistance:
Technical assistance was provided in the following areas of the standards: Background checks; 22VAC40-185-(4)-270 (Building maintenance); 22VAC40-185-(4)-330 (Play areas); 22VAC-185-(5)-350 (Supervision); 22VAC40-185-(8)-580 (Transportation)

Comments:
An unannounced monitoring inspection was conducted on 2/5/20 from 8:00am - 10:15am. During the inspection there were 67 children ages two years old through ten years old in care with seven staff. Children were observed leaving for the local public schools and participating in various activities in the classrooms and eating breakfast. Records were reviewed for seven children and nine staff. There was no medication at the center. Emergency procedures and emergency supplies were reviewed during the inspection. Areas of non-compliance are identified on the violation notice and were discussed during the exit interview.

Violations:
Standard #: 22VAC40-185-270-A
Description: Based on observation and interviews, it was determined that the facility did not ensure that all areas and equipment of the center shall be maintained in a safe and operable condition.

Evidence:
1. The yellow metal swing set on the large playground has areas where the paint is peeling.
2. There is a section of the siding on the white building located on the playground where the wood is damaged and has sharp edges.
3. The fence located behind the school age building has a section that is not secured to the post and now has sharp edges exposed.
4. Staff #2 confirmed the items listed above were not in a safe and operable condition.

Plan of Correction: The facility responded: All playground will be painted as well as the white building. All of this is done every spring. With the weather rain/cold it is hard to paint. Vice Principal will monitor and Principal will ensure.

Standard #: 22VAC40-185-350-E-3
Description: Based on observation and interviews, it was determined that the licensee did not ensure that for children, two years of age, a ratio of one staff member for every eight children is maintained at all times children are in care.

Evidence:
1. There were 26 children present with two staff in the classroom where the children were eating breakfast at approximately 8:40am.
2. When staff #2 was asked how old the youngest child was, staff #2 stated that child #6 was 2 years old. Based on the age of child #6, the required staff-to child ratio would be one staff for every eight children.
3. Additional staff arrived at the facility and entered into the classroom at approximately 9:00am
4. Staff #2 confirmed that the facility did not maintain the required staff-to-child ratio of one staff for every eight children for this grouping of children.

Plan of Correction: The facility responded: At the time the L.I. arrived the ratio was in compliance, but when buses left to take children to school the ratio dropped. We had one teacher call out sick which is normally present and we have changed the hours for the lead pre-k teacher to come in earlier. Vice Principal will monitor and Principal will ensure.

Standard #: 22VAC40-185-580-C
Description: Based on observation and interviews, it was determined that any vehicle used by the center for the transportation of children shall comply with the Virginia state statues about child restraints are followed to assure the safety of the children.

Evidence:
1. Van #1007, used for the daily transportation of children to and from the local public schools, was observed transporting five children under eight years old to school without booster seats as required by the code of Virginia.
2. Staff #6 confirmed that van #1007 did not have booster seats for all of the children under eight years old that were being transported to the local public school.

Plan of Correction: The facility responded: Booster will be on all vans and used by all children that the law requires. We were under false impression that children that were over a certain weight did not have to have booster seats, so were the parents. We have made the correction. Vice Principal will monitor all drivers and Principal will ensure.
