Comments:
On December 4, 2019, the Department received a complaint regarding care and protection, supervision, ratios and children?s injuries. The licensing inspector was on site conducting an unannounced inspection on December 19, 2019 from approximately 3:00 PM until 4:10 PM and on January 21, 2020 from approximately 12:30 PM until 3:00 PM. While on site, interviews with staff were conducted, observations were made and documentation was reviewed. Additional documentation was reviewed on February 10, 2020 off site. Based on the information gathered during the investigation, the preponderance of evidence supports portions of the allegation, therefore the complaint is valid.

Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice and returned it to me within five business days from today. Your plan of correction should contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventive measure(s).

Violations:
Standard #: 22VAC40-185-40-E
Complaint related: Yes
Description: Based on documentation review and interviews, the center did not maintain compliance with their own policies and procedures required by standards.

Evidence:
1. During the December 19, 2019 and January 21, 2020 interviews the following was documented: Two staff members stated [Child #1] ate a small piece of a Cheeto Puff at the Halloween party.
2. The center?s Food, Nutrition and Mealtime policy states ?all Staff Members must monitor the Allergy & Dietary Preference List prior to every meal, snack time, or using food products of any kind.?
3. An Allergy & Dietary Preference form was completed for [Child #1] stating the child is allergic to all dairy foods.
4. The ingredients list on the Cheetos Puffs? bag states ?contains milk ingredients?.

Plan of Correction: All staff received training on Food Care and Allergies. The Allergy/ Dietary lists have been updated and moved to the same location in every classroom to support teachers understanding and utilizing daily.

Standard #: 22VAC40-185-340-A
Complaint related: Yes
Description: Based on interviews and review of documentation, staff did not ensure the care and protection of a child in care with a known food allergy.
Evidence:
1. An Allergy & Dietary Preference form was completed for [Child #1] stating the child has an allergy to milk and dairy foods.
2. During the December 19, 2019 and January 21, 2020 interviews, six staff members were interviewed and the following was determined to have occurred: A staff member stated ?I knew [Child #1] could not eat dairy, no cheese anything with dairy products. I didn?t think about Cheetos having dairy. [Child #1] had one very small bite before we realized it. Another staff stated ?At the Halloween party we had Cheetos and cookies. [Child #1] ate a tiny piece of the end of the cheese puff before we realized it had dairy in it. We took the cheese puff from [Child #1] before he could eat anymore.
3. Six staff members stated they were aware Child #1 had a documented dairy allergy.
4. The ingredients list on the Cheetos Puffs? bag states ?contains milk ingredients?.

Plan of Correction: Staff and Management have been coached on understanding that maintaining a safe environment includes food/dietary practices. The District leader and other corporate support will continue to make periodic/random visits to ensure that the center is providing the appropriate care regarding children's allergies.
