Comments:
An unannounced complaint inspection was conducted on Wednesday, March 4, 2020 in response to two complaints that were received by the licensing office 02/25/2020. The inspector was on site from approximately 2:30 to 4:00 PM. Interviews with staff were completed, observations were made in the center and documentation was reviewed.

The preponderance of the evidence gathered during the investigation supports the allegation; therefore, the complaint is determined to be valid.

Standard #: 22VAC40-185-350-E-2
Complaint related: No
Description: Based on observation and an interview, the center failed to follow the required ratio of staff to children when 18 month old children are in the grouping.

Evidence:
1. In classroom #2, at approximately 2:35 PM, there were seven children, ages 18 months through two years, and one staff. Two staff members were required.
2. Staff reported that since November, the ratio requirements have not been maintained in classroom #2.
3. At approximately 3:20 PM, two children transitioned to classroom #3.
4. The director reported that classroom #2 was out of ratio and that no other staff were present to assistant at the center.

Description: Based on observation and an interview, the center did not ensure for two-year-old children, one staff member for every eight children.

Evidence:
1. In classroom #3, at approximately 2:37 PM, there were eleven children and one staff. Two staff members were required.
2. At approximately 3:15 PM an additional staff member was present in classroom #3.
3. The director reported that classroom #3 was out of ratio and that no other staff were present to assistant at the center.

Description: Based on observation and an interview, the center did not ensure for children three years to the age of eligibility to attend public school, one staff member for every ten children.

Evidence
1. In classroom #4, at approximately 2:39 PM, there were 18 children and one staff. Two staff were required. At approximately 3:09 PM, an additional staff member arrived in classroom #4.
2. In classroom #4, at approximately 3:21 PM, there were 21 children with two staff. Three staff were required. At approximately 3:28, the classroom was in ratio with 19 children and two staff.
3. In classroom #5, at approximately 2:41 PM, there were 20 children and one staff. Two staff were required. At approximately 3:14 PM, 10 children were present with one staff.
4. The director reported that classroom #4 and classroom #5 were out of ratio and that no other staff were present to assistant at the center.
