63.2(17) License & Registration Procedures

Comments:
The licensing inspector conducted an unannounced monitoring inspection from 10:00 am - 2:00 pm. There were 50 children in care with ten staff. The children were observed playing on the playground, during lunch and at nap time. Five staff's records and five children's records were reviewed. Violations from the previous inspection were also reviewed and three were repeated. Areas of non-compliance are identified on the violation notice. Violations:
Standard #: 22VAC40-185-270-A
Description: Based on observation, the center failed to maintain the facility in a safe and operable condition.
Evidence:
1. The inspector observed the outside play areas. Outside of the mulch barrier on the preschool playground, there are tree roots creating tripping hazards. There are also tree roots on the infant/toddler playground creating tripping hazards. The barrier for mulch on the preschool playground are pipes. One pipe located behind the climber is broken with sharp edges.

Plan of Correction: The center will place sand over the tree roots and then place a mat on top of the sand. Will also place additional sand around the mats to ensure they are not tripping hazards. The pipe will be removed from the playground.

Standard #: 22VAC40-185-280-B
Description: Based on observation, the center failed to have all hazardous substances stored in a locked place.
Evidence:
1. The inspector observed the center. There was a container of disinfectant spray and a container of hair spray in an unlocked base cabinet in the girl's bathroom on the church side.

Plan of Correction: The director placed a safety lock on the cabinet and staff will monitor to ensure it remains locked.

Standard #: 22VAC40-185-330-B
Description: Based on observation, the center failed to maintain resilient surfacing on the playground at the required depth of at least 6 inches.
Evidence:
1. The inspector observed the preschool playground. There was approximately 2 - 3 inches of mulch under and surrounding the climber. Fall height of the climber is approximately 40 inches. The inspector observed the infant/toddler playground. There was approximately 1 - 2 inches of mulch surrounding the Little Tikes climber. Fall height of this climber is approximately 15 inches.

Plan of Correction: Additional mulch will be added to these areas of the playground. Staff will monitor to ensure the mulch remains at the required depth.

Standard #: 22VAC40-191-60-C-2
Description: Based on record reviews, the center failed to ensure all staff have the results of a search of the central registry check by the end of the 30th day of employment.
Evidence:
1. The inspector reviewed five staff's records. One of five records reviewed (staff record #3) did not contain the results of a search of the central registry. Staff #3's date of employment was 10/10/2019.

Plan of Correction: The director mailed out the request for the search of the central registry on 03/10/2020. Staff #3 will not work at the center until the results of all background checks are received. Once the results are received, a copy will be mailed to the licensing office.

Standard #: 63.2(17)-1720.1-B-2
Description: Based on record reviews, the center failed to ensure all staff have the fingerprint based national criminal history search results prior to beginning employment.
Evidence:
1. The inspector reviewed five staff's records. One of five records reviewed (staff record #3) did not have the results of a fingerprint based national criminal history search prior to beginning employment. Staff #3's date of employment was 10/10/2019.

Plan of Correction: Staff #3 has scheduled an appointment to have the fingerprint based background check on 03/18/2020. Staff #3 will not work at the center until all background check results are received. Once the results of the fingerprint check are received, a copy of the results will be sent to the licensing office.
