An investigation was conducted in response to a self-report that was received in the licensing regarding allegations in the area of supervision and nutrition. Interviews were conducted with staff, records reviewed and observations of the program were made relating to the report. The information gathered during the investigation supports the allegation. Violations are noted in the violation notice.

Standard #: 22VAC40-185-340-A Description: Based on interviews and a record review, the center did not ensure staff were ensuring the care, protection and guidance of children when supervising them.
Evidence:
On April 6th around or about 3:15 pm, Staff #1 served a 6 year-old child #1 a snack containing a food ingredient the child is intolerant to.
1. Staff #1 served child #1 three goldfish crackers which contain a dairy ingredient, during snack. Child #1 was supposed to be served cereal and pineapple.
2. Child #1's record indicated she has an intolerance to dairy. The owner confirmed the center was aware child #1 has a food intolerance to dairy. The owner also confirmed there was a verbal agreement with the parent that an alternate snack would be served if the menu had a snack containing dairy. .Plan of Correction: The following plan of correction was provided by the owner during the exit interview:
The parent had recently spoken to the center about the child's dairy intolerance, as it was not listed on the child's physical. The parents are now providing all meals, to include snack. All staff are aware of the child's intolerance.
