63.2(17) License & Registration Procedures

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A renewal inspection was initiated on April 29, 2020 and concluded on May 1, 2020. The director was contacted by telephone to initiate the inspection. There were zero children present and three staff. The inspector emailed the director a list of items required to complete the inspection. The Inspector reviewed two children?s records, two staff records, and all board officer records submitted by the facility to ensure documentation was complete. Information gathered during the inspection determined non-compliance(s) with applicable standards or law and violations were documented on the violation notice issued to the facility.

Violations:
Standard #: 22VAC40-191-40-D-1-A
Description: Based on record review and interview, the center failed to ensure that a new person designated as applicant had a completed background check before the end of 30 days of becoming a Board officer (applicant).

Evidence:

1. Board officer #2 and #3 did not have any of the three forms completed that comprise a background check (sworn statement, central registry searches, and the criminal records checks) . Based on interview with the program director, the Board officers began their duties in January 2020.

Plan of Correction: "Officers #2 and #3 have been notified of the requirements and were given sworn statements. They will complete the other requirements ASAP, post-COVID-19 restrictions."

Standard #: 63.2(17)-1720.1-A
Description: Based on record review and discussion with the staff, the facility failed to ensure that all employees shall undergo background checks in accordance with the Code of Virginia and every five years thereafter.

Evidence:

The most recent central registry findings in the record for Staff #4 were dated 04/01/2014.

Plan of Correction: Staff #4's "last day is 05/15/2020."

Standard #: 63.2(17)-1720.1-B-3
Description: Based on record review and interview, the center failed to obtain a copy of the results of a search of the central registry maintained pursuant to 63.2-1515 and any child abuse and neglect registry or equivalent registry maintained by any other state in which the individual has resided in the preceding five years for any founded complaint of child abuse or neglect against the staff person.

Evidence:

1. Staff #3 had disclosed on the "Sworn Statement or Affirmation" form completed 04/16/2018 that the staff person had lived in another state, other than Virginia, in the last five years. According to Staff #3, the center had not obtained or requested information from the central registry in the state in which the staff person had lived.

Plan of Correction: "Employee #3 submitted a request for criminal background check to the State of LA on 05/04/2020."
