The licensing inspector conducted an unannounced complaint inspection in response to a complaint that was received by the Department on February 25, 2020 related to alleged forbidden actions, behavior guidance and mandated reporting. The inspection was initiated on February 26, 2020 and completed on May 12, 2020. On February 28, 2020, the licensing inspector was on site from 11:15am to approximately 12:58pm. Interviews with staff were completed, documentation was reviewed, and observations were made at the center. Additional interviews were completed on April 28, 2020. The preponderance of the evidence gathered during the investigation supports part of the allegation regarding behavior guidance; therefore the complaint is determined to be valid. Please complete the 'plan of correction' and 'date to be corrected' for each violation cited on the Violation Notice and return it to me within 5 business days from the date of receipt. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standards, 2) measures to prevent the noncompliance from occurring again, and 3) person(s) responsible for implementing each step and/or monitoring any preventative measure(s).

Standard #: 22VAC40-185-400-B Complaint related: Yes Description: Based on interviews and documentation review, the center did not ensure behavioral guidance was constructive in nature, age and stage appropriate, and intended to redirect children to appropriate behavior and resolve conflicts.
Evidence: 1) During interview, Staff #1 reported that on 02/20/20, Child #1 (3-year-old) was not listening to directions given by Staff #2 to read a book quietly. To redirect the child, Staff #1 ?sat [Child #1] down" and said "you have to start using your listening ears."
2) During interview, Staff #2 reported that on 02/20/20, Staff #1 used a loud tone of voice to redirect Child #1 and said ?[Staff #2] told you to sit down? and sat Child #1 down in a chair.
3) The licensing inspector reviewed a ?coaching form? dated 02/21/20 signed by Staff #1 and Administrator #1 which stated: ??Based on findings during the investigation, proper child guidance practices were not put into use. After conducting an investigation and consulting with the District Leader and Quality BP; it was determined that there was a coachable moment with Child Guidance. A final written warning will be issued as well as additional training on KinderCare policies and expectations of proper child guidance.?
4) During interview, Administrator #1 reported the coachable moment with Child Guidance was in reference to Staff #1?s tone of voice used while redirecting Child #1 on 02/20/20.Plan of Correction: Per the Center: "Center director provides on boarding and training upon hire includes positive child guidance other company policies relating to safety, behaviors, and other standards in compliance with licensing."
