Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A monitoring inspection was initiated on May 8, 2020 and concluded on June 22, 2020. A self-reported incident was received by the department regarding allegations in the areas of supervision, transportation, and center policies. The director was contacted by telephone to conduct the investigation. The inspector emailed the director a list of documentation required to complete the investigation.

The evidence gathered during the investigation supported the self-report of non-compliance with standards or law and violations were issued. Any violations not related to the self-report but identified during the course of the investigation can be found on the violation notice.

Violations:
Standard #: 22VAC40-185-40-E
Description: Based on a review of documents and staff interviews, the center did not ensure they complied with their own policies and procedures required by the Child Day Center Standards regarding transportation policies, and a child was left unsupervised on the vehicle after transportation.
EVIDENCE:
1. The center's Transportation Policies and Procedures states the following: "As each child physically gets on and off the vehicle the van driver must check them on/off. Drivers shall verify that all children have been removed from the vehicle after the children have been checked off the bus. Van drivers will take all students transported on their route to a designated staff member to verify that all children listed on the route have been properly checked on and off the bus. Name to face recognition must be used. The designee will confirm that all children not checked on and off are absent and a confirmation call has been made to the parent in the event that parent communication has not already been made. The designee must initial confirming that all children are accounted for."

2. During an interview on 5/27/20, Staff #2 stated she did not complete the transportation checklist on 5/7/2020, and she did not verify that all children were removed from the vehicle once they arrived at the center. Staff #2 stated that Staff #1 was the designated staff member on 5/7/2020, and that Staff #1 did not verify the transportation checklist, which requires name to face recognition.

3. During an interview on 5/20/2020, Staff #1 stated being the staff designated to verify that all children arriving on the bus with Staff #2 were properly checked on and off the bus. Staff #1 did not verify the transportation checklist which requires name to face recognition on 5/7/2020.

4. This resulted in Child #1, who is three years old, being left alone in an unlocked bus for approximately 12 minutes on 5/7/2020.

Plan of Correction: Per administration, "to ensure that transportation policies are upheld, only management level staff will be responsible for bus check offs. Bus checklists will be randomly audited by a corporate director to ensure compliance."

Standard #: 22VAC40-185-340-A
Description: Based on a review of documentation, a review of videotape and staff interviews; the center did not ensure that when staff are supervising children, they shall always ensure their care, protection, and guidance.
EVIDENCE:
1. On 5/26/2020, the licensing inspector viewed a videotape recording from 5/7/2020. The video showed that at approximately 9:35 AM, Staff #2 exited the bus and entered the center. At approximately 9:45 AM, Staff #3 asked Staff #2 if Child #1, who is three years old, had been transported to the center. Staff #2 affirmed that she was and Staff #2 was observed to exit the center. At approximately 9:47 AM Staff #2 and Child #1 were observed entering the center at a side entrance, and Child #1 entered a classroom.

2. In an interview on 5/27/2020, Staff #2 stated that on 5/7/2020, she parked the bus at the front entrance of the center and entered the building. She returned to the bus to look for her bookbag and discovered that Child #1 had been left alone on the bus and was asleep. She then escorted Child #1 to the entrance nearest to the child's classroom and knocked. Staff #3 opened the door and Child #1 entered her classroom.

3. The bus was parked in the center's parking lot within approximately 50 feet of the main entrance. This parking area is adjacent to a transportation business and a side street.

Plan of Correction: Per administration, "managers will take a more active role in transportation operations by completing all check off lists and ensuring each child transported exits safely to their designated classroom after name to face check off has been completed."

Standard #: 22VAC40-185-340-F
Description: Based on a review of documentation, a review of videotape, and staff interviews; the center did not ensure that children under 10 years of age always shall be within actual sight and sound supervision of staff.
EVIDENCE:
1. On 5/7/2020, Child #1, who is three years old\, was left alone and unsupervised on a center bus for approximately 12 minutes after being transported from home to the center.

2. On 5/26/2020, the licensing inspector viewed a videotape recording from 5/7/2020. The video showed that at approximately 9:35 AM, Staff #2 exited the bus and entered the center. At approximately 9:45 AM, Staff #3 asked Staff #2 if Child #1 had been transported to the center. Staff #2 affirmed that she was and Staff #2 was observed to exit the center. At approximately 9:47 AM Staff #2 and Child #1 were observed entering the center at a side entrance, and Child #1 entered a classroom.

Standard #: 22VAC40-185-580-K
Description: Based on staff interviews and a review of documentation, the center failed to ensure that staff shall verify that all children are removed from vehicles at the conclusion of a trip.
EVIDENCE:
1. During an interview, Staff #1 stated that on the morning of 5/7/2020, Staff #3 gave her the task of escorting children from the bus into the building, and completing a transportation checklist. Upon arriving at the door used for bus arrivals, Staff #1 found the children were lined up waiting to exit the bus and Staff #2 handed her the transportation checklist. Staff #1 stated the center policy is that children are to remain seated and buckled until they are confirmed by staff marking their name on the transportation checklist. Staff #1 escorted the children into the center. She states that neither she nor Staff #2 completed the transportation checklist.

2. During an interview, Staff #2 stated that on the morning of 5/7/2020, she was transporting children to the center and texted administration to announce their arrival. Staff #2 parked at the side entrance used for morning bus arrivals and unbuckled the children. The children lined up at the door of the bus. When Staff #1 arrived, Staff #2 gave her the transportation checklist, and it was not completed by either staff member. Staff #1 escorted the children into the center and Staff #2 parked the bus in the parking lot by the main entrance. Staff #2 exited the bus and entered the building. Staff #2 returned to the bus to look for her bookbag and found Child #1, who is three years old, asleep on the bus.

3. On 5/26/2020, the licensing inspector reviewed videotape footage for 5/7/2020, and observed that Staff #2 exited the bus after parking it at approximately 9:35 AM. Staff #2 was then observed to enter the building at approximately 9:47 AM with Child #1.

Plan of Correction: Per administration, "effective immediately, only management level staff will be responsible for checking students off buses upon arrival to the center. Managers will also complete the signature portion at the bottom, on the checklist, for each center arrival.
