Comments:
An unannounced complaint inspection was conducted on 03/05/2020 from 8:50 am to 12:20 pm in response to a complaint received by the Valley Licensing Office on 02/21/2020. On 04/28/2020 more information was requested from administrators. Six interviews were conducted with the staff, two children's records, one staff record, policies and procedures, attendance records were reviewed. The information gathered during the investigation does support the allegation, so the complaint is determined to be "valid". The exceptions to compliance are noted on the violation notice.

Please complete the "plan of correction" and "date to be corrected" for each violation cited on the violation notice and return it to me within 10 calendar days from today. You will need to specify how the deficient practice will be or has been corrected. Just writing the word "corrected" is not acceptable. Your plan of correction must contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventive measure(s).

Complaint related: Yes
Description: Based on staff interviews, staff failed to interact with one child to provide needed help, comfort, and support to promote the child's physical, intellectual, emotional, and social well-being and growth.

Evidence:

1. Staff #1 stated that Child #1, age 21 months, cries uncontrollably when the door opens and closes. Staff #1 states that she was instructed to place Child #1 in buckled chair and place him in the hallway outside the classroom with the door open. Child #1 calms down after a few moments.
2. Staff #2 and administration reported that is how Child #1 calms down.

Plan of Correction: Staff has been interacting with children to provide comfort and support for children that are upset for whatever reason or may need reassuring. Staff has been striving to ensure children's emotional, physical, intellectual, social well-being and growth is being addressed thoroughly. Complaint related: Yes
Description: Based on staff interviews, the center failed to ensure staff did not restrict movement through binding.

Evidence:

1. Staff #1 reported that Child #1 is placed in the hallway outside of the classroom when the child does not stop crying.
2. Staff #2 reported that the child is buckled in the chair for safety while sitting outside of the classroom.

Plan of Correction: In no circumstance has staff put children in chairs that restrict movement by means of binding or by straps. If child feels more comfortable with space away from the group staff will sit child in an open area that in no way restricts child's movement. Complaint related: No
Description: Based on observation and verification from staff, the center did not ensure staff disposed disposable diapers in a leakproof or plastic-lined storage system that is either foot operated or used in such a way that neither the staff member's hand nor the soiled diaper touches an exterior surface of the storage system during disposal.

Evidence:

1. Staff #3 opened the waste can lid with her hand and disposed a soiled diaper.
2. Staff #3 verified that she did not use the food pedal to open the waste can lid, but used her hand. Staff #3 stated that the foot pedal did not work.

Plan of Correction: Administration has ensured that each classroom has a trash can that is equipped with working foot pedals. Staff has been disposing of soiled diapers by using the foot pedals. If for any reason foot pedals stop functioning staff members will alert administration immediately. Staff responsible for implementing each step and/or monitoring preventive measures: Cassandra Allgood, Natalia Botkins, Dasija Burton.
