63.2(17) License & Registration Procedures

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A monitoring inspection was initiated on 11/30/20 and concluded on 12/4/20. The center owner was contacted by telephone to initiate the inspection. There were 10 children present and 2 staff. The inspector emailed the center owner a list of items required to complete the inspection. The Inspector reviewed 2 children's record and 1 staff record submitted by the facility to ensure documentation was complete. Information gathered during the inspection determined non-compliances with applicable standards or law and violations were documented on the violation notice issued to the facility.

The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care programs.

Violations:
Standard #: 22VAC40-185-140-A
Description: Based on record review and interview, the center did not ensure that each child shall have a physical examination by or under the direction of a physician before the child's attendance or within one month after attendance.

Evidence:
1. The record for child 1 (date of enrollment: 9/8/20) does not contain documentation of a physical examination.
2. The center owner confirmed that the record for child 1 is lacking documentation of a physical examination.

Plan of Correction: The center responded with the following: The center owner contacted child 1's parent to obtain a copy of the physical.

Standard #: 22VAC40-185-160-A
Description: Based on record review and interview, it was determined that the center did not ensure that each staff member submitted a tuberculosis (Tb) screening within 21 days of employment.

Evidence:
1. The record for staff 1 (date of hire: 1/1/20) does not contain documentation of a TB screening.
2. The center owner confirmed that the record for staff 1 is lacking documentation of a TB screening.

Plan of Correction: The center responded with the following: Staff 1 did obtain a TB screening but documentation of the results could not be found during the inspection. If the TB screening can not be located, staff 1 will obtain a new one, which will be placed in his staff record.

Standard #: 22VAC40-191-60-C-2
Description: Based on record review and interview, the center did not ensure that all staff have a central registry finding within 30 days of employment.

Evidence:
1. The record for staff 1 does not contain documentation of a central registry finding. Staff 1 has a date of hire of 1/1/20 and was working on the day of the inspection.
2. The center owner confirmed that the record for staff 1 is lacking documentation of a central registry finding.

Plan of Correction: The center responded with the following: A central registry search request for staff 1 was submitted upon hire; however, the results were unable to be located during the inspection. The center owner has contacted the Office of Background Investigations to request a new copy of the search results. Once, obtained the results will be placed in staff 1's record and will also be forwarded to the licensing inspector.

Standard #: 63.2(17)-1720.1-B-2
Description: Based on record review and interview, the center did not ensure that the results of the fingerprint based criminal history records check is obtained before an employee's first day of employment.

Evidence:
1. Staff 1 has a hire date of 1/1/20. The results of the fingerprint based background check for staff 1 was not received until 1/8/20.
2. The center owner confirmed that staff 1 began employment prior to the results of the fingerprint background checks being received.

Plan of Correction: The center responded with the following: Going forward, all fingerprint based background checks will be obtained before new staff begin employment.
