Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia. A complaint inspection was initiated on 10/09/20 and concluded on 11/16/2020. A complaint was received by the department regarding allegations in the area of supervision. The directowas contacted by telephone to conduct the investigation. The inspector emailed the director/provider a list of documentation required to complete the investigation. The evidence gathered during the investigation supported the allegation of non-compliance with standards or law and violations were issued. Any violations not related to the complaint but identified during the course of the investigation can be found on the violation notice.

Complaint related: No
Description: Based on a record review, observations and interviews, the center did not ensure the center's activities were maintained with the standards and the center's own policies and procedures.
Evidence:

1. On 10/07/20, staff #1 did not follow the center's own supervision policy, when she was unaware that a 2 year-old child in her care had been left outside and unsupervised on the playground for approximately 10 minutes. The center's supervision policy, provided by the director and entitled, "Identifying where children are at all times," states: "Each teacher is responsible for knowing the whereabouts of the children in his/her group at all times. We continuously count noses to be sure that everyone is where they are supposed to be."

2. The director stated staff are required to fill out a "Face-to-Name" transition sheet, recording each time staff are responsible for transitioning children from one place to another. The Director reported this procedure is covered during new staff orientation. "Face-to-Name" sheet dated 10/07/2020 did not include any transitions to or from the playground. The sheet also did not accurately reflect the number of children in care. According to the face-to-name sheet, 11 children arrived in the two year-old classroom by 10:15am, yet the same document showed a total of 10 children accounted for between the two staff with the 11th student unaccounted for.

Plan of Correction: Children?s Harbor will follow procedures emailed to the inspector as a plan of correction. All new staff will be trained on the information upon hiring and all current staff will be trained on this information by Friday Jan. 8th.

Complaint related: No
Description: Based on observations, interviews, a record review and the scope and serious nature of the violations, the center did not ensure the care, protection and guidance of the children in care.
Evidence:

1. On 10/07/20, 2 year-old child #1 was left on a playground, unsupervised, for at least 10 minutes. The playground faces the center's parking lot that is visible through the chain link fence that surrounds it. A man leaving the center who was unknown to child #1, reported he rubbed the child's hand through the fence, "in an effort to comfort him," before going inside to report seeing the unsupervised child.

2. Child #1 had access to all playground equipment while unsupervised. The center was unable to provide documentation identifying the playground equipment and its safety, manufacturer age requirements and/or limitations.

Plan of Correction: Children?s Harbor will follow procedures emailed to the inspector as a plan of correction. All new staff will be trained on the information upon hiring and all current staff will be trained on this information by Friday Jan. 8th.

Description: Based on observations, interviews and a record review, the center did not ensure children under the age of 10 years-old were within actual sight and sound supervision of staff.
Evidence:
On 10/07/20, 2 year-old child #1 was left on a playground, unsupervised, for at least 10 minutes until someone from the public saw the child and went inside the daycare to report it.

Plan of Correction: Children?s Harbor will follow procedures emailed to the inspector as a plan of correction. All new staff will be trained on the information upon hiring and all current staff will be trained on this information by Friday Jan. 8th.
