63.2(17) License & Registration Procedures

Technical Assistance:
Legislation effective July 1, 2020 reviewed - with an emphasis on new out-of-state background check requirements for staff.
Written information outlining these changes has been emailed to the director.

Standard 70.A.2 Discussed:
If a staff reference check is taken over the phone documentation shall include:
a. & e. Dates of contact and signature of person making the call.

Comments:
This inspection was conducted by licensing staff using an alternate protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A monitoring inspection was initiated on 12/15/2020 and concluded on 12/22/2020. The director was contacted by telephone to initiate the inspection. There were 30 children present and 5 staff. The inspector emailed the director a list of items required to complete the inspection. The inspector reviewed 3 staff records and 3 children's records submitted by the facility to ensure documentation was complete.

Information gathered during the inspection determined non-compliances with applicable law and violations were documented on the violation notice issued to the facility.

The licensing inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care Programs.

Violations:
Standard #: 63.2(17)-1720.1-B-3
Description: Based on record review and interview, the center failed to obtain a copy of information from the central registry maintained pursuant to ? 63.2-1515 on any investigation of child abuse or neglect undertaken on him within any state the employee has resided in within the past five years.

Evidence:
1. The results of a central registry check, from the State of Georgia, were not on file for staff 1.
a. Staff 1 has resided in the State of Georgia within the past five years as indicated on her sworn statement or affirmation.
b. Staff 1 has a hire date of 10/26/2020.
2. Administrative staff confirmed that a central regisry check had not been obtained for staff 1.

Plan of Correction: A criminal record check, from the State of Georgia, was requested by mistake. A central registry check will be requested today.

Standard #: 63.2(17)-1720.1-B-4
Description: Based on record review and interview, the center failed to obtain a copy of the results of a sex offender registry check from any state in which the applicant has resided in the preceding five years. All applicants for employment and employees shall undergo a background check in accordance with subsection B prior to employment and every five years thereafter.

Evidence:
1. The results of a sex offender check, from the State of Georgia, were not on file for staff 1.
a. Staff 1 has resided in the State of Georgia within the past five years as indicated on her sworn statement or affirmation.
b. Staff 1 has a hire date of 10/26/2020.
2. Administrative staff confirmed that a sex offender check had not been obtained for staff 1.

Plan of Correction: A sex offender check was completed, during the inspection, from the State of Georgia. The results are clear. A copy of this will be placed in staff 1's file.
